      105 ILCS 5/10-16          from Ch. 122, par. 10-16
          Amends the School Code.  Provides that in 1999 and  2001,
      the  requirement  that  a school board organize within 7 days
      after its election  refers  to  7  days  after  the  November
      commencement  of terms of members elected the previous April.
      Removes an  obsolete  reference  to  the  election  of  board
      members at the nonpartisan election.  Effective immediately.

 1        AN  ACT  to  amend  the  School  Code by changing Section
 2    10-16.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  School  Code  is  amended  by changing
 6    Section 10-16 as follows:

 8        Sec. 10-16. Organization of Board. Within  7  days  after
 9    the  election  the  board  shall  organize  by  electing  its
10    officers  and  fixing  a  time  and  place  for  the  regular
11    meetings,  except  that  in  1999  and  2001, the Board shall
12    organize within 7 days after the termination of the terms  of
13    those board members whose terms end in November 1999 or 2001,
14    respectively.  It  shall then enter upon the discharge of its
15    duties.
16        The regional superintendent of schools having supervision
17    and control over the district as provided in  Section  3-14.2
18    of  this  Act  shall convene the newly elected board within 7
19    days after the election of the board of education of any  new
20    district  governed  by  this  Act,  whereupon the board shall
21    proceed  to  organize  by  electing  1  of  their  number  as
22    president and electing a secretary, who may or may not  be  a
23    member.   At  such  meeting the length of term of each of the
24    members shall be determined by lot so that 4 shall serve  for
25    4  years,  and  3  for 2 years from the commencement of their
26    terms; provided, however, if such members were not elected at
27    the  nonpartisan  election  in  an  odd-numbered  year,  such
28    initial terms shall be extended to the  nonpartisan  election
29    for school board members immediately following the expiration
30    of  the  initial  4  or  2 year terms. The provisions of this
31    paragraph that relate to the determination of  terms  by  lot

 1    shall  not  apply  to  the  initial  members  of the board of
 2    education of a combined school district who are to be elected
 3    to unstaggered terms  as  provided  in  subsection  (a-5)  of
 4    Section 11B-7. The terms of the officers shall be for 2 years
 5    except  that  the  board by resolution may establish a policy
 6    for the terms of office to be one year, and provide  for  the
 7    election of officers.
 8        Special  meetings of the board of education may be called
 9    by the president or by any 3 members of the board  by  giving
10    notice  thereof  in  writing,  stating  the  time,  place and
11    purpose of the meeting. Such notice may be served by mail  48
12    hours  before  such  meeting  or by personal service 24 hours
13    before such meeting. Public notice of meetings must  also  be
14    given  as  prescribed  in  Sections 2.02 and 2.03 of the Open
15    Meetings Act, as now or hereafter amended.
16        At each regular and special meeting which is open to  the
17    public,  members  of the public and employees of the district
18    shall be afforded time, subject to reasonable constraints, to
19    comment to or ask questions of the board.
20        The president or district superintendent shall,  at  each
21    regular  board  meeting,  report  any  requests  made  of the
22    district under provisions of The Freedom of  Information  Act
23    and shall report the status of the district's response.

25        Section  99.  Effective date.  This Act takes effect upon
26    becoming law.
