LRB9008538MWgc LRB9008538MWgc 1 AN ACT concerning health care facilities, amending named 2 Acts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Nursing Home Care Act is amended by 6 changing Section 3-202 as follows: 7 (210 ILCS 45/3-202) (from Ch. 111 1/2, par. 4153-202) 8 Sec. 3-202. The Department shall prescribe minimum 9 standards for facilities. These standards shall regulate: 10 (1) Location and construction of the facility, including 11 plumbing, heating, lighting, ventilation, and other physical 12 conditions which shall ensure the health, safety, and comfort 13 of residents and their protection from fire hazard; 14 (2) Number and qualifications of all personnel, 15 including management and nursing personnel, having 16 responsibility for any part of the care given to residents; 17 specifically, the Department shall establish staffing ratios 18 for facilities which shall specify the number of staff hours 19 per resident of care that are needed for professional nursing 20 care for various types of facilities or areas within 21 facilities; 22 (3) All sanitary conditions within the facility and its 23 surroundings, including water supply, sewage disposal, food 24 handling, and general hygiene, which shall ensure the health 25 and comfort of residents; 26 (4) Diet related to the needs of each resident based on 27 good nutritional practice and on recommendations which may be 28 made by the physicians attending the resident; 29 (5) Equipment essential to the health and welfare of the 30 residents; 31 (6) A program of habilitation and rehabilitation for -2- LRB9008538MWgc 1 those residents who would benefit from such programs; 2 (7) A program for adequate maintenance of physical plant 3 and equipment; 4 (8) Adequate accommodations, staff and services for the 5 number and types of residents for whom the facility is 6 licensed to care, including standards for temperature and 7 relative humidity within comfort zones determined by the 8 Department based upon a combination of air temperature, 9 relative humidity and air movement. Such standards shall 10 also require facility plans that provide for health and 11 comfort of residents at medical risk as determined by the 12 attending physician whenever the temperature and relative 13 humidity are outside such comfort zones established by the 14 Department. 15 (9) Development of evacuation and other appropriate 16 safety plans for use during weather, health, fire, physical 17 plant, environmental and national defense emergencies; and 18 (10) Maintenance of minimum financial or other resources 19 necessary to meet the standards established under this 20 Section, and to operate and conduct the facility in 21 accordance with this Act. 22 The Department shall by rule require a facility licensed 23 under this Act to develop an automatic weather emergency 24 warning system at the facility. 25 (Source: P.A. 83-1530.) 26 Section 10. The Hospital Licensing Act is amended by 27 adding Section 9.5 as follows: 28 (210 ILCS 85/9.5 new) 29 Sec. 9.5. Weather emergency warning system. The 30 Department shall by rule require a facility licensed under 31 this Act to develop an automatic weather emergency warning 32 system at the facility.
