      745 ILCS 49/12 new
          Amends the Good Samaritan Act. Provides that a person who
      has successfully completed certain training requirements  and
      who,  in  good faith, not for compensation, renders emergency
      medical care involving  the  use  of  an  automatic  external
      defibrillator is not liable for any civil damages as a result
      of  any  act  or  omission,  except  for  willful  and wanton
      misconduct, by that person  in  rendering  that  care.   Also
      creates  an  exemption from civil liability for a business or
      organization  that  employs   such   a   person.    Effective
      immediately.

 1        AN  ACT to amend the Good Samaritan Act by adding Section
 2    12.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.  The  Good Samaritan Act is amended by adding
 6    Section 12 as follows:
 7        (745 ILCS 49/12 new)
 8        Sec. 12. Use  of  an  automatic  external  defibrillator;
 9    exemption  from  civil  liability  for  emergency  care.  Any
10    person  who   has   successfully   completed   the   training
11    requirements  of a course in basic emergency care of a person
12    in cardiac arrest that:
13             (i) included training in the operation and use of an
14        automatic external defibrillator; and
15             (ii) was conducted in accordance with the  standards
16        of the American Heart Association,
17    and  who,  in  good  faith,  not  for  compensation,  renders
18    emergency  medical  care  involving  the  use of an automatic
19    external  defibrillator  in  accordance  with  his   or   her
20    training  is  not liable for any civil damages as a result of
21    any  act  or  omission,  except  for   willful   and   wanton
22    misconduct, by that person in rendering that care. A business
23    or  organization  that employs a person who renders emergency
24    care in good faith, not for compensation, in accordance  with
25    this  Section is not liable for any civil damages as a result
26    of any  act  or  omission,  except  for  willful  and  wanton
27    misconduct, by the person rendering the care or for providing
28    the  automatic  external  defibrillator to the person for the
29    purpose of rendering the care.
30        Section 99.  This Act takes effect upon becoming law.
