Amends the Criminal Code of 1961 to add the Public Safety
and Recreational Firearms Use Protection Law to the Code.
Prohibits the manufacture, transfer, and possession of
semiautomatic assault weapons. Exempts the weapons if
lawfully possessed under federal law on September 13, 1994.
Exempts certain listed firearms as those firearms were
manufactured on October 1, 1993. Exempts manually operated
bolt, pump, lever, or slide action firearms; permanently
inoperable firearms; and antique firearms. Exempts certain
semiautomatic rifles and shotguns. Exempts from the
prohibition the transfer to or possession by a law
enforcement officer employed by a governmental unit of
semiautomatic assault weapons used for law enforcement
purposes. Establishes penalties. Requires the Attorney
General to investigate and study the effect of these
provisions and to report his or her findings to the General
Assembly and the Governor. Sunsets the Public Safety and
Recreational Firearms Use Protection Law on Septmber 13,
2004. Effective immediately.

1 AN ACT to amend the Criminal Code of 1961 by adding
2 Article 24.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Criminal Code of 1961 is amended by
6 adding Article 24.5 as follows:
7 (720 ILCS 5/Art. 24.5 heading new)
8 ARTICLE 24.5. ASSAULT WEAPONS
9 (720 ILCS 5/24.5-1 new)
10 Sec. 24.5-1. Short title. This Article may be cited as
11 the Public Safety and Recreational Firearms Use Protection
12 Law.
13 (720 ILCS 5/24.5-5 new)
14 Sec. 24.5-5. Restriction on manufacture, transfer, and
15 possession of certain semiautomatic assault weapons.
16 (a)(1) It shall be unlawful for a person to
17 manufacture, transfer, or possess a semiautomatic assault
18 weapon.
19 (2) Paragraph (1) shall not apply to the
20 possession or transfer of any semiautomatic assault
21 weapon otherwise lawfully possessed under federal law on
22 September 13, 1994.
23 (3) Paragraph (1) shall not apply to:
24 (A) any of the firearms, or replicas or
25 duplicates of the firearms, specified in subsection
26 (e) of this Section, as such firearms were
27 manufactured on October 1, 1993;
28 (B) any firearm that:
29 (i) is manually operated by bolt, pump,

1 lever, or slide action;
2 (ii) has been rendered permanently
3 inoperable; or
4 (iii) is an antique firearm;
5 (C) any semiautomatic rifle that cannot
6 accept a detachable magazine that holds more than 5
7 rounds of ammunition; or
8 (D) any semiautomatic shotgun that cannot
9 hold more than 5 rounds of ammunition in a fixed or
10 detachable magazine.
11 The fact that a firearm is not listed in subsection (e)
12 shall not be construed to mean that paragraph (1) applies to
13 such firearm. No firearm exempted by this subsection may be
14 deleted from subsection (e) so long as this subsection is in
15 effect.
16 (4) Paragraph (1) shall not apply to:
17 (A) the manufacture for, transfer to, or
18 possession by the United States or a department or
19 agency of the United States or this State or any
20 other state or a department, agency, or political
21 subdivision of this State or any other state, or a
22 transfer to or possession by a law enforcement
23 officer employed by such an entity for purposes of
24 law enforcement (whether on or off duty);
25 (B) the transfer to a licensee under title I
26 of the federal Atomic Energy Act of 1954 for
27 purposes of establishing and maintaining an on-site
28 physical protection system and security
29 organization required by federal law, or possession
30 by an employee or contractor of such licensee
31 on-site for such purposes or off-site for purposes
32 of licensee-authorized training or transportation
33 of nuclear materials;
34 (C) the possession, by an individual who is

1 retired from service with a law enforcement agency
2 and is not otherwise prohibited from receiving a
3 firearm, of a semiautomatic assault weapon
4 transferred to the individual by the agency upon
5 such retirement; or
6 (D) the manufacture, transfer, or possession
7 of a semiautomatic assault weapon by a licensed
8 manufacturer or licensed importer for the purposes
9 of testing or experimentation authorized by the
10 Director of State Police.
11 (b) The term "semiautomatic assault weapon" means:
12 (1) any of the firearms, or copies or duplicates
13 of the firearms in any caliber, known as:
14 (i) Norinco, Mitchell, and Poly Technologies
15 Avtomat Kalashnikovs (all models);
16 (ii) Action Arms Israeli Military Industries
17 UZI and Galil;
18 (iii) Beretta Ar70 (SC-70);
19 (iv) Colt AR-15;
20 (v) Fabrique National FN/FAL, FN/LAR, and
21 FNC;
22 (vi) SWD M-10, M-11, M-11/9, and M-12;
23 (vii) Steyr AUG;
24 (viii) INTRATEC TEC-9, TEC-DC9 and TEC- 22;
25 and
26 (ix) revolving cylinder shotguns, such as (or
27 similar to) the Street Sweeper and Striker 12;
28 (2) a semiautomatic rifle that has an ability to
29 accept a detachable magazine and has at least 2 of:
30 (i) a folding or telescoping stock;
31 (ii) a pistol grip that protrudes
32 conspicuously beneath the action of the weapon;
33 (iii) a bayonet mount;
34 (iv) a flash suppressor or threaded barrel

1 designed to accommodate a flash suppressor; and
2 (v) a grenade launcher;
3 (3) a semiautomatic pistol that has an ability to
4 accept a detachable magazine and has at least 2 of:
5 (i) an ammunition magazine that attaches to
6 the pistol outside of the pistol grip;
7 (ii) a threaded barrel capable of accepting a
8 barrel extender, flash suppressor, forward
9 handgrip, or silencer;
10 (iii) a shroud that is attached to, or
11 partially or completely encircles, the barrel and
12 that permits the shooter to hold the firearm with
13 the nontrigger hand without being burned;
14 (iv) a manufactured weight of 50 ounces or
15 more when the pistol is unloaded; and
16 (v) a semiautomatic version of an automatic
17 firearm; and
18 (4) a semiautomatic shotgun that has at least 2
19 of:
20 (i) a folding or telescoping stock;
21 (ii) a pistol grip that protrudes
22 conspicuously beneath the action of the weapon;
23 (iii) a fixed magazine capacity in excess of
24 5 rounds; and
25 (iv) an ability to accept a detachable
26 magazine.
27 (c) Sentence.
28 (1) A violation of subsection (a) of this Section
29 is a Class 3 felony.
30 (2) A person who, during and in relation to a crime
31 of violence or drug trafficking crime (including a crime
32 of violence or drug trafficking crime that provides for
33 an enhanced punishment if committed by the use of a
34 deadly or dangerous weapon or device), uses or carries a

1 semiautomatic assault weapon, in addition to the
2 punishment provided for such crime of violence or drug
3 trafficking crime, shall be sentenced to a term of
4 imprisonment of 10 years for a first conviction and 20
5 years for a second or subsequent conviction under this
6 paragraph (2). In this paragraph (2):
7 (A) "Drug trafficking crime" means any felony
8 punishable under the Illinois Controlled Substances
9 Act.
10 (B) "Crime of violence" means an offense that
11 is a felony and:
12 (i) has as an element the use, attempted
13 use, or threatened use of physical force
14 against the person or property of another; or
15 (ii) that by its nature, involves a
16 substantial risk that physical force against
17 the person or property of another may be used
18 in the course of committing the offense.
19 (d) The serial number of any semiautomatic assault
20 weapon manufactured after the effective date of this
21 amendatory Act of 1997 shall clearly show the date on which
22 the weapon was manufactured.
23 (e) The following weapons are subject to the provisions
24 of paragraph (3) of subsection (a) of this Section:

20 (720 ILCS 5/24.5-10 new)
21 Sec. 24.5-10. Ban of large capacity ammunition feeding
22 devices.
23 (a)(1) Except as provided in paragraph (2), it shall be
24 unlawful for a person to transfer or possess a large
25 capacity ammunition feeding device.
26 (2) Paragraph (1) shall not apply to the possession or
27 transfer of any large capacity ammunition feeding device
28 otherwise lawfully possessed on or before the date of the
29 enactment of this subsection.
30 (3) This subsection shall not apply to:
31 (A) the manufacture for, transfer to, or
32 possession by the United States or a department or agency
33 of the United States or this State or a department,

1 agency, or political subdivision of this State, or a
2 transfer to or possession by a law enforcement officer
3 employed by such an entity for purposes of law
4 enforcement (whether on or off duty);
5 (B) the transfer to a licensee under title I of
6 the federal Atomic Energy Act of 1954 for purposes of
7 establishing and maintaining an on-site physical
8 protection system and security organization required by
9 Federal law, or possession by an employee or contractor
10 of such licensee on-site for such purposes or off-site
11 for purposes of licensee-authorized training or
12 transportation of nuclear materials;
13 (C) the possession, by an individual who is retired
14 from service with a law enforcement agency and is not
15 otherwise prohibited from receiving ammunition, of a
16 large capacity ammunition feeding device transferred to
17 the individual by the agency upon such retirement; or
18 (D) the manufacture, transfer, or possession of
19 any large capacity ammunition feeding device by a
20 licensed manufacturer or licensed importer for the
21 purposes of testing or experimentation authorized by the
22 State.
23 (4) If a person charged with violating paragraph
24 (1) asserts that paragraph (1) does not apply to such
25 person because of paragraph (2) or (3), the State shall
26 have the burden of proof to show that such paragraph
27 (1) applies to such person. The lack of a serial number as
28 described in subsection (d) of Section 24.5-5, shall be a
29 presumption that the large capacity ammunition feeding
30 device is not subject to the prohibition of possession in
31 paragraph (1).
32 (b) In this Section the term "large capacity ammunition
33 feeding device":
34 (1) means a magazine, belt, drum, feed strip, or

1 similar device manufactured after the date of enactment
2 of the Violent Crime Control and Law Enforcement Act of
3 1994 that has a capacity of, or that can be readily
4 restored or converted to accept, more than 10 rounds of
5 ammunition; but
6 (2) does not include an attached tubular device
7 designed to accept, and capable of operating only with,
8 .22 caliber rimfire ammunition.
9 (c) Sentence. A violation of subsection (a) of this
10 Section is a Class 3 felony.
11 (d) A large capacity ammunition feeding device
12 manufactured after the effective date of this amendatory Act
13 of 1997 shall be identified by a serial number that clearly
14 shows that the device was manufactured after that effective
15 date and such other identification as the Director of State
16 Police may by regulation prescribe.

18 Sec. 24.5-15. Study by Attorney General.
19 (a) The Attorney General shall investigate and study
20 the effect of this Article, and in particular shall determine
21 its impact, if any, on violent and drug trafficking crime.
22 The study shall be conducted over a period of 18 months,
23 commencing 12 months after the effective date of this
24 amendatory Act of 1997.
25 (b) Not later than 30 months after the effective date
26 of this amendatory Act of 1997, the Attorney General shall
27 prepare and submit to the General Assembly and the Governor
28 a report setting forth in detail the findings and
29 determinations made in the study under subsection (a).

31 Sec. 24.5-20. This Article is repealed on September 13,
32 2004.
