In a municipality with more than 500,000 inhabitants, creates a Citizens Review Board to monitor housing authority police, with 3 members appointed by the Governor, 2 members appointed by the presiding officer of the municipality, and one member appointed by each of the legislative leaders of the General Assembly. Authorizes the Board to suspend, terminate, or take other disciplinary action against an officer who verbally or physically abused a tenant or tenant's guest or invitee while on or off duty or who entered the residence of a tenant unlawfully. Effective immediately. LRB9000869SMcw SB25 Enrolled LRB9000869SMcw 1 AN ACT to amend the Housing Authorities Act by adding 2 Section 8.1c. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Housing Authorities Act is amended by 6 adding Section 8.1c as follows: 7 (310 ILCS 10/8.1c new) 8 Sec. 8.1c. Citizens Review Board. A Citizens Review 9 Board is established for the housing authority in any 10 municipality having over 500,000 inhabitants to monitor the 11 housing authority police force. 12 The Board shall consist of 9 members with 5 appointed by 13 the executive director of the housing authority, 2 appointed 14 by the housing authority's Central Advisory Council, and 2 15 appointed by the housing authority's Senior Advisory Council. 16 The initial terms of the members shall be one, 2, 3, 4, and 17 5 years for the members appointed by the executive director, 18 one and 2 years for the members appointed by the Central 19 Advisory Council, and one and 2 years for the members 20 appointed by the Senior Advisory Council. The appointing 21 authority shall determine which initial term each appointee 22 shall serve. Each successor of the initial members shall 23 serve for a term of 4 years. The initial appointments to the 24 Board shall be made within 30 days of the effective date of 25 this amendatory Act of 1997. The Board shall select one of 26 its members to serve as chairperson. The Board may, after 27 notice and a hearing, remove by majority vote a member of the 28 Board who has been found guilty of neglect of duty or 29 malfeasance. If a member of the Board resigns or is removed, 30 the official or body that would appoint the member's 31 successor shall appoint a person to serve the remainder of SB25 Enrolled -2- LRB9000869SMcw 1 the member's term. After a member's term expires, the member 2 shall continue to serve until a successor is appointed and 3 qualified. 4 Subject to collective bargaining agreements, the Board 5 has the authority, after holding a hearing, to suspend, 6 terminate, or take other disciplinary action against a 7 housing authority police officer if: 8 (1) the officer is found by the Board to have 9 physically abused a tenant or his or her guest while the 10 officer was on duty; 11 (2) the officer is found by the Board to have 12 entered the residence of a housing authority tenant and 13 was neither (i) executing a legally issued arrest warrant 14 or search warrant for that residence nor (ii) otherwise 15 lawfully present in the residence; or 16 (3) the officer is found by the Board to have 17 physically abused a person on or off housing authority 18 property while performing his or her duty as a housing 19 authority police officer. 20 Section 99. Effective date. This Act takes effect upon 21 becoming law.
