90_SB0186enr 625 ILCS 5/1-224 from Ch. 95 1/2, par. 1-224 Amends the Illinois Vehicle Code to provide that the definition of "rescue vehicle" includes a vehicle designed, configured, and equipped for the transportation of organs. LRB9001951NTsb SB186 Enrolled LRB9001951NTsb 1 AN ACT to amend the Illinois Vehicle Code by adding 2 Section 1-154.4 and changing Sections 12-215 and 12-601. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Vehicle Code is amended by 6 adding Section 1-154.4 and changing Sections 12-215 and 7 12-601 as follows: 8 (625 ILCS 5/1-154.4 new) 9 Sec. 1-154.4. Organ transport vehicle. A motor vehicle 10 of the second division equipped and used exclusively for the 11 transportation of organs for human transplant or the 12 transportation of members of the surgical team performing the 13 organ harvesting or transplant operations. Vehicles defined 14 in this Section shall be owned or operated by a company that 15 has a contractual agreement with a federally designated organ 16 procurement organization for the purposes stated in this 17 Section. 18 (625 ILCS 5/12-215) (from Ch. 95 1/2, par. 12-215) 19 (Text of Section before amendment by P.A. 89-507) 20 Sec. 12-215. Oscillating, rotating or flashing lights on 21 motor vehicles. Except as otherwise provided in this Code: 22 (a) The use of red or white oscillating, rotating or 23 flashing lights, whether lighted or unlighted, is prohibited 24 except on: 25 1. Law enforcement vehicles of State, Federal or 26 local authorities; 27 2. A vehicle operated by a police officer or county 28 coroner and designated or authorized by local 29 authorities, in writing, as a law enforcement vehicle; 30 however, such designation or authorization must be SB186 Enrolled -2- LRB9001951NTsb 1 carried in the vehicle; 2 3. Vehicles of local fire departments and State or 3 federal firefighting vehicles; 4 4. Vehicles which are designed and used exclusively 5 as ambulances or rescue vehicles; furthermore, such 6 lights shall not be lighted except when responding to an 7 emergency call for and while actually conveying the sick 8 or injured; and 9 5. Tow trucks licensed in a state that requires 10 such lights; furthermore, such lights shall not be 11 lighted on any such tow truck while the tow truck is 12 operating in the State of Illinois. 13 (b) The use of amber oscillating, rotating or flashing 14 lights, whether lighted or unlighted, is prohibited except 15 on: 16 1. Second division vehicles designed and used for 17 towing or hoisting vehicles; furthermore, such lights 18 shall not be lighted except as required in this paragraph 19 1; such lights shall be lighted when such vehicles are 20 actually being used at the scene of an accident or 21 disablement and while such vehicles are engaged in towing 22 on a highway; 23 2. Motor vehicles or equipment of the State of 24 Illinois, local authorities and contractors; furthermore, 25 such lights shall not be lighted except while such 26 vehicles are engaged in maintenance or construction 27 operations within the limits of construction projects; 28 3. Vehicles or equipment used by engineering or 29 survey crews; furthermore, such lights shall not be 30 lighted except while such vehicles are actually engaged 31 in work on a highway; 32 4. Vehicles of public utilities, municipalities, or 33 other construction, maintenance or automotive service 34 vehicles except that such lights shall be lighted only as SB186 Enrolled -3- LRB9001951NTsb 1 a means for indicating the presence of a vehicular 2 traffic hazard requiring unusual care in approaching, 3 overtaking or passing while such vehicles are engaged in 4 maintenance, service or construction on a highway; 5 5. Oversized vehicle or load; however, such lights 6 shall only be lighted when moving under permit issued by 7 the Department under Section 15-301 of this Code; 8 6. The front and rear of motorized equipment owned 9 and operated by the State of Illinois or any political 10 subdivision thereof, which is designed and used for 11 removal of snow and ice from highways; 12 7. Fleet safety vehicles registered in another 13 state, furthermore, such lights shall not be lighted 14 except as provided for in Section 12-212 of this Code; 15 8. Such other vehicles as may be authorized by 16 local authorities; 17 9. Law enforcement vehicles of State or local 18 authorities when used in combination with red 19 oscillating, rotating or flashing lights; 20 10. Vehicles used for collecting or delivering mail 21 for the United States Postal Service provided that such 22 lights shall not be lighted except when such vehicles are 23 actually being used for such purposes; 24 11. Any vehicle displaying a slow-moving vehicle 25 emblem as provided in Section 12-205.1; 26 12. All trucks equipped with self-compactors or 27 roll-off hoists and roll-on containers for garbage or 28 refuse hauling. Such lights shall not be lighted except 29 when such vehicles are actually being used for such 30 purposes; 31 13. Vehicles used by a security company, alarm 32 responder, or control agency, if the security company, 33 alarm responder, or control agency is bound by a contract 34 with a federal, State, or local government entity to use SB186 Enrolled -4- LRB9001951NTsb 1 the lights; and 2 14. Security vehicles of the Department of Mental 3 Health and Developmental Disabilities; however, the 4 lights shall not be lighted except when being used for 5 security related purposes under the direction of the 6 superintendent of the facility where the vehicle is 7 located. 8 (c) The use of blue oscillating, rotating or flashing 9 lights, whether lighted or unlighted is prohibited except: 10 1. On vehicles owned or fully operated by a: 11 voluntary firefighter; 12 paid firefighter; 13 part-paid firefighter; 14 call firefighter; 15 member of the board of trustees of a fire 16 protection district; 17 paid or unpaid member of a rescue squad; 18 paid or unpaid member of a voluntary ambulance 19 unit; 20 rescue squad vehicles not owned by a fire 21 department. 22 However, such lights are not to be lighted except 23 when responding to a bona fide emergency. 24 2. Police department vehicles in cities having a 25 population of 500,000 or more inhabitants. 26 3. Law enforcement vehicles of State or local 27 authorities when used in combination with red 28 oscillating, rotating or flashing lights. 29 4. Vehicles of local fire departments and State or 30 federal firefighting vehicles when used in combination 31 with red oscillating, rotating or flashing lights. 32 5. Vehicles which are designed and used exclusively 33 as ambulances or rescue vehicles when used in combination 34 with red oscillating, rotating or flashing lights; SB186 Enrolled -5- LRB9001951NTsb 1 furthermore, such lights shall not be lighted except when 2 responding to an emergency call. 3 (d) The use of a combination of amber and white 4 oscillating, rotating or flashing lights, whether lighted or 5 unlighted, is prohibited, except motor vehicles or equipment 6 of the State of Illinois, local authorities and contractors 7 may be so equipped; furthermore, such lights shall not be 8 lighted except while such vehicles are engaged in highway 9 maintenance or construction operations within the limits of 10 highway construction projects. 11 (e) All oscillating, rotating or flashing lights 12 referred to in this Section shall be of sufficient intensity, 13 when illuminated, to be visible at 500 feet in normal 14 sunlight. 15 (f) Nothing in this Section shall prohibit a 16 manufacturer of oscillating, rotating or flashing lights or 17 his representative from temporarily mounting such lights on a 18 vehicle for demonstration purposes only. 19 (g) Any person violating the provisions of subsections 20 (a), (b), (c) or (d) of this Section who without lawful 21 authority stops or detains or attempts to stop or detain 22 another person shall be guilty of a Class 4 felony. 23 (h) Except as provided in subsection (g) above, any 24 person violating the provisions of subsections (a) or (c) of 25 this Section shall be guilty of a Class A misdemeanor. 26 (Source: P.A. 88-58; 88-341; 88-670, eff. 12-2-94; 89-433, 27 eff. 12-15-95.) 28 (Text of Section after amendment by P.A. 89-507) 29 Sec. 12-215. Oscillating, rotating or flashing lights on 30 motor vehicles. Except as otherwise provided in this Code: 31 (a) The use of red or white oscillating, rotating or 32 flashing lights, whether lighted or unlighted, is prohibited 33 except on: 34 1. Law enforcement vehicles of State, Federal or SB186 Enrolled -6- LRB9001951NTsb 1 local authorities; 2 2. A vehicle operated by a police officer or county 3 coroner and designated or authorized by local 4 authorities, in writing, as a law enforcement vehicle; 5 however, such designation or authorization must be 6 carried in the vehicle; 7 3. Vehicles of local fire departments and State or 8 federal firefighting vehicles; 9 4. Vehicles which are designed and used exclusively 10 as ambulances or rescue vehicles; furthermore, such 11 lights shall not be lighted except when responding to an 12 emergency call for and while actually conveying the sick 13 or injured; and 14 5. Tow trucks licensed in a state that requires 15 such lights; furthermore, such lights shall not be 16 lighted on any such tow truck while the tow truck is 17 operating in the State of Illinois. 18 (b) The use of amber oscillating, rotating or flashing 19 lights, whether lighted or unlighted, is prohibited except 20 on: 21 1. Second division vehicles designed and used for 22 towing or hoisting vehicles; furthermore, such lights 23 shall not be lighted except as required in this paragraph 24 1; such lights shall be lighted when such vehicles are 25 actually being used at the scene of an accident or 26 disablement and while such vehicles are engaged in towing 27 on a highway; 28 2. Vehicles of public utilities, municipalities, or 4 other construction, maintenance or automotive service 5 vehicles except that such lights shall be lighted only as 6 a means for indicating the presence of a vehicular 7 traffic hazard requiring unusual care in approaching, 8 overtaking or passing while such vehicles are engaged in 9 maintenance, service or construction on a highway; 10 5. Oversized vehicle or load; however, such lights 11 shall only be lighted when moving under permit issued by 12 the Department under Section 15-301 of this Code; 13 6. Security vehicles of the Department of Human 8 Services; however, the lights shall not be lighted except 9 when being used for security related purposes under the 10 direction of the superintendent of the facility where the 11 vehicle is located. 12 (c) The use of blue oscillating, rotating or flashing 13 lights, whether lighted or unlighted is prohibited except: 14 1. On vehicles owned or fully operated by a: 15 voluntary firefighter; 16 paid firefighter; 17 part-paid firefighter; 18 call firefighter; 19 member of the board of trustees of a fire 20 protection district; 21 paid or unpaid member of a rescue squad; 22 paid or unpaid member of a voluntary ambulance 23 unit; 24 rescue squad vehicles not owned by a fire 25 department. 26 However, such lights are not to be lighted except 27 when responding to a bona fide emergency. 28 2. Police department vehicles in cities having a 29 population of 500,000 or more inhabitants. 30 3. Law enforcement vehicles of State or local 31 authorities when used in combination with red 32 oscillating, rotating or flashing lights. 33 4. Vehicles of local fire departments and State or 34 federal firefighting vehicles when used in combination SB186 Enrolled -9- LRB9001951NTsb 1 with red oscillating, rotating or flashing lights. 2 5. Vehicles which are designed and used exclusively 3 as ambulances or rescue vehicles when used in combination 4 with red oscillating, rotating or flashing lights; 5 furthermore, such lights shall not be lighted except when 6 responding to an emergency call. 7 6. Vehicles that are equipped and used exclusively 8 as organ transport vehicles when used in combination with 9 red oscillating, rotating, or flashing lights; 10 furthermore, these lights shall only be lighted when the 11 transportation is declared an emergency by a member of 12 the transplant team or a representative of the organ 13 procurement organization. 14 (d) The use of a combination of amber and white 15 oscillating, rotating or flashing lights, whether lighted or 16 unlighted, is prohibited, except motor vehicles or equipment 17 of the State of Illinois, local authorities and contractors 18 may be so equipped; furthermore, such lights shall not be 19 lighted except while such vehicles are engaged in highway 20 maintenance or construction operations within the limits of 21 highway construction projects. 22 (e) All oscillating, rotating or flashing lights 23 referred to in this Section shall be of sufficient intensity, 24 when illuminated, to be visible at 500 feet in normal 25 sunlight. 26 (f) Nothing in this Section shall prohibit a 27 manufacturer of oscillating, rotating or flashing lights or 28 his representative from temporarily mounting such lights on a 29 vehicle for demonstration purposes only. 30 (g) Any person violating the provisions of subsections 31 (a), (b), (c) or (d) of this Section who without lawful 32 authority stops or detains or attempts to stop or detain 33 another person shall be guilty of a Class 4 felony. 34 (h) Except as provided in subsection (g) above, any SB186 Enrolled -10- LRB9001951NTsb 1 person violating the provisions of subsections (a) or (c) of 2 this Section shall be guilty of a Class A misdemeanor. 3 (Source: P.A. 88-58; 88-341; 88-670, eff. 12-2-94; 89-433, 4 eff. 12-15-95; 89-507, eff. 7-1-97.) 5 (625 ILCS 5/12-601) (from Ch. 95 1/2, par. 12-601) 6 (Text of Section before amendment by P.A. 89-687) 7 Sec. 12-601. Horns and warning devices. 8 (a) Every motor vehicle when operated upon a highway 9 shall be equipped with a horn in good working order and 10 capable of emitting sound audible under normal conditions 11 from a distance of not less than 200 feet, but no horn or 12 other warning device shall emit an unreasonable loud or harsh 13 sound or a whistle. The driver of a motor vehicle shall when 14 reasonably necessary to insure safe operation give audible 15 warning with his horn but shall not otherwise use such horn 16 when upon a highway. 17 (b) No vehicle shall be equipped with nor shall any 18 person use upon a vehicle any siren, whistle, or bell, except 19 as otherwise permitted in this section. Any authorized 20 emergency vehicle as defined in Chapter 1 of this Act may be 21 equipped with a siren, whistle, or bell, capable of emitting 22 sound audible under normal conditions from a distance of not 23 less than 500 feet, but such siren, whistle or bell, shall 24 not be used except when such vehicle is operated in response 25 to an emergency call or in the immediate pursuant of an 26 actual or suspected violator of the law in either of which 27 events the driver of such vehicle shall sound such siren, 28 whistle or bell, when necessary to warn pedestrians and other 29 drivers of the approach thereof. 30 (c) Trackless trolley coaches, as defined by Section 31 1-206 of this Code, may be equipped with a bell or bells in 32 lieu of a horn, and may, in addition to the requirements of 33 paragraph (a) of this Section, use a bell or bells for the SB186 Enrolled -11- LRB9001951NTsb 1 purpose of indicating arrival or departure at designated 2 stops during the hours of scheduled operation. 3 (Source: P.A. 89-345, eff. 1-1-96.) 4 (Text of Section after amendment by P.A. 89-687) 5 Sec. 12-601. No acceleration or delay. Where this Act 4 makes changes in a statute that is represented in this Act by 5 text that is not yet or no longer in effect (for example, a 6 Section represented by multiple versions), the use of that 7 text does not accelerate or delay the taking effect of (i) 8 the changes made by this Act or (ii) provisions derived from 9 any other Public Act.
