90_SB0187 10 ILCS 5/9-25.3 new 30 ILCS 505/11.8 new 30 ILCS 510/18 new 30 ILCS 515/40-1 new Amends the Election Code. Prohibits a political committee from accepting a contribution in excess of $500 from any person who has been awarded State contracts in excess of $100,000, who has submitted bids for contracts in excess of $100,000, or has in the aggregate received contracts or submitted bids for contracts in excess of $100,000. Provides that a prohibited contribution must be returned within one business day. Provides that a political committee must notify the State Board of Elections within 2 business days of returned contributions. Provides that a violation is a Class A misdemeanor. Provides that a contributor must be notified that a contribution may be prohibited. Amends the Illinois Purchasing Act, the State Paper Purchasing Act, and the State Printing Contracts Act. Requires each State agency to make a list of persons who have been awarded contracts or submitted bids for contracts in excess of $100,000 available to the State Board of Elections, the Attorney General, or any State's Attorney. LRB9001808MWpc LRB9001808MWpc 1 AN ACT concerning campaign finance, amending named Acts. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Election Code is amended by adding 5 Section 9-25.3 as follows: 6 (10 ILCS 5/9-25.3 new) 7 Sec. 9-25.3. Contributions from State contractors 8 prohibited. No political committee authorized to accept 9 contributions under this Article shall accept any 10 contribution in excess of $500 in any reporting period from 11 any person who has been awarded a contract or contracts from 12 any agency or combination of agencies of State government in 13 excess of $100,000 within the last 18 months, who has 14 submitted bids for contracts to any agency or combination of 15 agencies of State government in excess of $100,000 in the 16 last 18 months, or who has in the aggregate received 17 contracts and submitted bids in excess of $100,000 from and 18 to any agency or combination of agencies of State government 19 in the last 18 months. 20 A political committee that receives a contribution in 21 excess of $500 in any reporting period must provide the 22 contributor with a Contract Disclosure Statement within one 23 business day after the receipt of the contribution. The 24 contributor must notify the political committee within one 25 business day if the contribution is in violation of this 26 Section. If the contribution is in violation of this 27 Section, the political committee must return the contribution 28 within one business day. 29 A political committee that has returned a contribution to 30 a contributor that is in violation of this Section must 31 notify the Board within 2 business days after returning the -2- LRB9001808MWpc 1 contribution. The notice to the Board shall contain the 2 name, address, and occupation of the contributor. The Board 3 shall maintain a record of the receipt of these notices. 4 The Board has the authority to investigate any violation 5 of this Section and recommend action to the Attorney General 6 or the appropriate State's Attorney. 7 For the purposes of this Section, "person" includes any 8 political committee, individual, corporation, political 9 action committee formed under 1 U.S.C. 441b (2) (C), group of 10 individuals, business entity, or any other entity that makes 11 a contribution to a political committee formed under the laws 12 of this State. 13 The candidate on whose behalf a political committee was 14 formed and who accepts a donation in violation of this 15 Section is guilty of a Class A misdemeanor. Any person who 16 makes a contribution in violation of this Section is guilty 17 of a Class A misdemeanor. 18 The Contract Disclosure Statement required by this 19 Section shall be in a form approved by the Board. The 20 Statement shall contain substantially the following: 21 "Contract Disclosure Statement 22 Name and address of Political Committee:.................... 23 Amount of contribution:................... 24 Notice: The political committee to which you have made a 25 donation in excess of $500 is required by law to submit this 26 statement to you. If you have received a contract in excess 27 of $100,000 from any State agency or agencies in the past 18 28 months, or have submitted bids in excess of $100,000 to any 29 State agency or agencies in the past 18ths months, or any 30 combination of contracts and bids from and to a State agency 31 or agencies in excess of $100,000 in the last 18 months, you -3- LRB9001808MWpc 1 are prohibited by law from making a donation in excess of 2 $500 in any 6-month period to a political committee formed 3 under the laws of the State of Illinois. 4 If you are prohibited from making the donation, the 5 political committee to which you have contributed must return 6 the contribution within one business day after receipt of the 7 notice from you that the contribution is in violation of the 8 law. As the contributor, you must notify the political 9 committee within one business day after receiving this 10 statement if the contribution is in violation of the law. 11 Your failure to notify the committee that you are prohibited 12 from making the donation is a Class A misdemeanor that can 13 carry the penalty of up to 2 years imprisonment and a fine of 14 up to $1,000. The failure of the political committee to 15 return the contribution to you within 2 business days can 16 result in a Class A misdemeanor that can carry the penalty of 17 imprisonment up to one year and a fine of up to $1,000. A 18 copy of this statement will be furnished to the State Board 19 of Elections." 20 Section 10. The Illinois Purchasing Act is amended by 21 adding Section 11.8 as follows: 22 (30 ILCS 505/11.8 new) 23 Sec. 11.8 List of contractors. Each State agency shall 24 make available to the State Board of Elections, the Attorney 25 General, and any State's Attorney upon request a list of the 26 persons who, over the previous 18 months, have been awarded 27 contracts for the delivery of services or goods from the 28 State agency in excess of $100,000, have submitted bids for 29 contracts for the delivery of services or goods in excess of 30 $100,000, or have in the aggregate received contracts for the 31 delivery of services and goods and submitted bids for 32 contracts for the delivery of services and goods in excess of -4- LRB9001808MWpc 1 $100,000. 2 Section 15. The State Paper Purchasing Act is amended by 3 adding Section 18 as follows: 4 (30 ILCS 510/18 new) 5 Sec. 18. List of contractors. Each State agency shall 6 make available to the State Board of Elections, the Attorney 7 General, and any State's Attorney upon request a list of the 8 persons who, over the previous 18 months, have been awarded 9 contracts for the delivery of services or goods from the 10 State agency in excess of $100,000, have submitted bids for 11 contracts for the delivery of services or goods in excess of 12 $100,000, or have in the aggregate received contracts for the 13 delivery of services and goods and submitted bids for 14 contracts for the delivery of services and goods in excess of 15 $100,000. 16 Section 20. The State Printing Contracts Act is amended 17 by adding Section 40-1 as follows: 18 (30 ILCS 515/40-1 new) 19 Sec. 40-1. List of contractors. Each State agency shall 20 make available to the State Board of Elections, the Attorney 21 General, and any State's Attorney upon request a list of the 22 persons who, over the previous 18 months, have been awarded 23 contracts for the delivery of services or goods from the 24 State agency in excess of $100,000, have submitted bids for 25 contracts for the delivery of services or goods in excess of 26 $100,000, or have in the aggregate received contracts for the 27 delivery of services and goods and submitted bids for 28 contracts for the delivery of services and goods in excess of 29 $100,000.
