 1                    AMENDMENT TO SENATE BILL 196
 2        AMENDMENT NO.     .  Amend Senate Bill 196  by  replacing
 3    the title with the following:
 4        "AN  ACT to amend the Illinois Insurance Code by changing
 5    Section 143.10b."; and
 6    by replacing everything after the enacting  clause  with  the
 7    following:
 8        "Section  5.   The  Illinois Insurance Code is amended by
 9    changing Section 143.10b as follows:
10        (215 ILCS 5/143.10b) (from Ch. 73, par. 755.10b)
11        Sec. 143.10b. (1)  Loss  information,  private  passenger
12    automobile.
13        (1)  All   companies  issuing  a  "policy  of  automobile
14    insurance" as defined in paragraph (a) of Section  143.13  of
15    this  Code  shall,  on  or after January 1, 1990, provide the
16    following loss information for the 5  three  previous  policy
17    years  to  the  named insured within 30 days of the insured's
18    written request:
19             (a)  on  closed  claims,  date  and  description  of
20        occurrence, and total amount of payments;
21             (b)  on  open  claims,  date  and   description   of

 1        occurrence and total amount of payments;
 2             (c)  for  any  occurrence not included in (a) or (b)
 3        of  this  subsection,  the  date   and   description   of
 4        occurrence.
 5        (2)  If  a  company  fails  to provide the information as
 6    required by  this  Section  with  such  frequency  so  as  to
 7    indicate  a practice of refusing to provide such information,
 8    such failure shall constitute an  unfair  trade  practice  as
 9    defined  in  Section  424  and  subject  to those hearing and
10    penalty provisions as set forth in Sections 425  through  434
11    of this Code.
