      720 ILCS 5/11-9           from Ch. 38, par. 11-9
          Amends the Criminal Code of 1961 relating to the  offense
      of   public  indecency.  Provides  that  a  second  or  third
      violation for public indecency is a Class A  misdemeanor  for
      which   the   offender  shall  be  sentenced  to  a  term  of
      imprisonment. A fourth or subsequent violation is a  Class  4
      felony. For second or subsequent public indecency violations,
      the   court   shall   order  the  offender  to  undergo  such
      psychiatric or psychological counseling and treatment as  the
      court may direct.

 1        AN  ACT  to  amend  the Criminal Code of 1961 by changing
 2    Section 11-9.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Criminal  Code  of  1961 is amended by
 6    changing Section 11-9 as follows:
 7        (720 ILCS 5/11-9) (from Ch. 38, par. 11-9)
 8        Sec. 11-9. Public indecency.
 9        (a)  Any person of the age of 17 years  and  upwards  who
10    performs  any of the following acts in a public place commits
11    a public indecency:
12             (1)  An act of sexual penetration or sexual  conduct
13        as defined in Section 12-12 of this Code; or
14             (2)  A lewd exposure of the body done with intent to
15        arouse or to satisfy the sexual desire of the person.
16        Breast-feeding  of  infants  is  not  an  act  of  public
17    indecency.
18        (b)  "Public  place"  for  purposes of this Section means
19    any place where the conduct may reasonably be expected to  be
20    viewed by others.
21        (c)  Sentence.
22        Public  indecency  is  a Class A misdemeanor. A second or
23    third violation of this Section is a Class A misdemeanor  for
24    which   the   offender  shall  be  sentenced  to  a  term  of
25    imprisonment.  A  fourth  or  subsequent  violation  of  this
26    Section is a Class 4 felony. The court shall order  a  person
27    convicted of a second or subsequent violation of this Section
28    to  undergo  such psychiatric or psychological counseling and
29    treatment as the court may direct.
