1 AMENDMENT TO SENATE BILL 299
2 AMENDMENT NO. . Amend Senate Bill 299, AS AMENDED,
3 in Section 5, Sec. 39, subsection (c), second paragraph, in
4 the sentence beginning "Upon application to the Agency",
5 before "the Agency shall conduct", by inserting the
6 following:
7 "the permit applicant shall cause written notice of the
8 permit application to be served upon the appropriate county
9 board or governing body of the municipality that granted
10 siting approval for that facility and upon any party to the
11 siting proceeding pursuant to which siting approval was
12 granted. In that event,"; and
13 in Section 5, Sec. 39, subsection (i), by replacing the
14 sentence beginning "Before issuing any RCRA permit" with the
15 following:
16 "Before issuing any RCRA permit or any permit for a waste
17 storage site, sanitary landfill, waste disposal site, waste
18 transfer station, waste treatment facility, or waste
19 incinerator the conduct of any waste-transportation or
20 waste-disposal operation, the Agency shall conduct an
21 evaluation of the prospective owner's or operator's prior
22 experience in waste management operations."; and
23 in Section 5, Sec. 39, subsection (i), in the sentence

1 beginning "The Agency may deny", by replacing "prospective
2 operator", each time it appears, with "prospective owner or
3 operator"; and
4 in Section 5, Sec. 39, subsection (i), item (1), by replacing
5 "refuse disposal" with "waste management refuse disposal";
6 and
7 in Sec. 39, subsection (i), item (3), by replacing "any
8 hazardous waste" with "any hazardous waste".
