210 ILCS 50/3.55
Amends the Emergency Medical Services (EMS) Systems Act.
Provides that a person approved as a First Responder or
licensed as an EMT-B, EMT-I, or EMT-P who has successfully
completed an approved course in automated defibrillator
operation and who is functioning within an approved EMS
System may use an automated defibrillator.

1 AN ACT in relation to emergency services.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the
5 Water Rescue Act.
6 Section 5. Findings. In so much as police, fire, and
7 emergency medical service departments are recognized as
8 necessary public safety organizations, the State of Illinois
9 hereby recognizes the longstanding role and purpose of those
10 persons specially trained in performing surface and
11 underwater rescue and recovery of persons and property within
12 the waterways of Illinois for the purpose of public safety
13 and accident prevention. For purposes of furthering public
14 safety and promoting safe use of Illinois waterways, this Act
15 has been created for the benefit of citizens and visitors to
16 this State and its many communities.
17 Section 10. Authorization. Municipalities, counties,
18 and political subdivisions of this State have authority to
19 authorize, fund, and continue support for water
20 rescue/recovery departments within their jurisdictions for
21 the purpose of the surface and underwater rescue and recovery
22 of persons and property.
23 Section 15. Intergovernmental agreements. Such
24 municipalities, counties, and political subdivisions may by
25 intergovernmental agreement combine funding and authorization
26 of such departments within a county if desired.
27 Section 50. The Emergency Medical Services (EMS) Systems
28 Act is amended by changing Section 3.55 as follows:

2 Sec. 3.55. Licensed EMT; Scope of practice.
3 (a) Any person currently licensed as an EMT-B, EMT-I, or
4 EMT-P may perform emergency and non-emergency medical
5 services as defined in this Act, in accordance with his or
6 her level of education, training and licensure, the standards
7 of performance and conduct prescribed by the Department in
8 rules adopted pursuant to this Act, and the requirements of
9 the EMS System in which he or she practices, as contained in
10 the approved Program Plan for that System.
11 (a-5) A person currently approved as a First Responder
12 or licensed as an EMT-B, EMT-I, or EMT-P who has successfully
13 completed a Department approved course in automated
14 defibrillator operation and who is functioning within a
15 Department approved EMS System may utilize such automated
16 defibrillator according to the standards of performance and
17 conduct prescribed by the Department in rules adopted
18 pursuant to this Act and the requirements of the EMS System
19 in which he or she practices, as contained in the approved
20 Program Plan for that System.
21 (b) A person currently licensed as an EMT-B, EMT-I, or
22 EMT-P may only practice as an EMT or utilize his or her EMT
23 license in pre-hospital or inter-hospital emergency care
24 settings or non-emergency medical transport situations, under
25 the written or verbal direction of the EMS Medical Director.
26 For purposes of this Section, a "pre-hospital emergency care
27 setting" may include a location, that is not a health care
28 facility, which utilizes EMTs to render pre-hospital
29 emergency care prior to the arrival of a transport vehicle.
30 The location shall include communication equipment and all of
31 the portable equipment and drugs appropriate for the EMT's
32 level of care, as required by this Act, rules adopted by the
33 Department pursuant to this Act, and the protocols of the EMS
34 Systems, and shall operate only with the approval and under

1 the direction of the EMS Medical Director.
2 This Section shall not prohibit an EMT-B, EMT-I, or EMT-P
3 from practicing within an emergency department or other
4 health care setting for the purpose of receiving continuing
5 education or training approved by the EMS Medical Director.
6 This Section shall also not prohibit an EMT-B, EMT-I, or
7 EMT-P from seeking credentials other than his or her EMT
8 license and utilizing such credentials to work in emergency
9 departments or other health care settings under the
10 jurisdiction of that employer.
11 (c) A person currently licensed as an EMT-B, EMT-I, or
12 EMT-P may honor Do Not Resuscitate (DNR) orders and powers of
13 attorney for health care only in accordance with rules
14 adopted by the Department pursuant to this Act and protocols
15 of the EMS System in which he or she practices.
16 (d) A student enrolled in a Department approved
17 emergency medical technician program, while fulfilling the
18 clinical training and in-field supervised experience
19 requirements mandated for licensure or approval by the System
20 and the Department, may perform prescribed procedures under
21 the direct supervision of a physician licensed to practice
22 medicine in all of its branches, a qualified registered
23 professional nurse or a qualified EMT, only when authorized
24 by the EMS Medical Director.

26 Section 99. Effective date. This Section and Sections
27 1, 5, 10, and 15 take effect upon becoming law.
