90_SB0340 720 ILCS 5/12-21.6 Amends the Criminal Code of 1961, relating to the offense of endangering the life or health of a child. Provides that endangering the life of a child is a Class 3 felony for a first offense and a Class 2 felony for a second or subsequent offense. If death of the child results, it is a Class X felony. Provides that endangering the health of a child is a Class A misdemeanor for a first offense and a Class 3 felony for a second or subsequent offense (now the current law for endangering either the life or health of the child). The Criminal Code of 1961 is amended by 6 changing Section 12-21.6 as follows: 7 (720 ILCS 5/12-21.6) 8 Sec. 12-21.6. Endangering the life or health of a child. 9 (a) It is unlawful for any person having the care or 10 custody of a child under the age of 18 to willfully cause or 11 permit the lifeor healthof theachildunder the age of 1812 to be endangered or to willfully cause or permit the child to 13 be placed in circumstances that endanger the child's lifeor14health. 15 (b) It is unlawful for any person having the care or 16 custody of a child under the age of 18 to willfully cause or 17 permit the health of the child to be endangered or to 18 willfully cause or permit the child to be placed in 19 circumstances that endanger the child's health. 20 (c) A violation of subsection (a) of this Section is a 21Class A misdemeanor. A second or subsequent violation of22this Section is aClass 3 felony. A second or subsequent 23 violation of subsection (a) of this Section is a Class 2 24 felony. A violation of subsection (a) of this Section that 25 results in the death of the child is a Class X felony. A 26 violation of subsection (b) of this Section is a Class A 27 misdemeanor. A second or subsequent violation of subsection 28 (b) of this Section is a Class 3 felony. 29 (Source: P.A. 88-479.)
