      30 ILCS 105/5.449 new
      625 ILCS 5/3-639 new
          Amends the Illinois Vehicle Code and  the  State  Finance
      Act.   Authorizes  special license plates designated as Child
      Protection plates.  Provides for  increased  fees  for  these
      plates  to be paid as grants to hospitals providing pediatric
      care, subject to appropriation by the  General  Assembly  and
      approval  by  the  Secretary  of  State.    Creates the Child
      Protection Fund Advisory Panel to make recommendations on the
      approval of grant applications to the Secretary of State.

 1        AN ACT concerning vehicles, amending named Acts.
 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:
 4        Section  5.  The  State  Finance Act is amended by adding
 5    Section 5.449 as follows:
 6        (30 ILCS 105/5.449 new)
 7        Sec. 5.449.  The Child Protection Fund.
 8        Section 10.  The Illinois  Vehicle  Code  is  amended  by
 9    adding Section 3-639 as follows:

11        Sec. 3-639.  Child protection license plate.
12        (a)  The  Secretary,  upon receipt of an application made
13    in the form prescribed by the Secretary,  may  issue  special
14    registration plates designated to be Child Protection plates.
15    The special plates issued under this Section shall be affixed
16    only  to  passenger  vehicles  of the first division or motor
17    vehicles of the second division weighing not more than  8,000
18    pounds.    Plates  issued  under  this  Section  shall expire
19    according to the multi-year procedure established by  Section
20    3-414.1 of this Code.
21        (b)  The  design  and color of the plates shall be wholly
22    within  the  discretion  of   the   Secretary.    Appropriate
23    documentation,   as   determined   by  the  Secretary,  shall
24    accompany the application.
25        (c)  An applicant shall be charged a $85 dollar  fee  for
26    original issuance in addition to the appropriate registration
27    fee, if applicable.  Of this fee, $25 shall be deposited into
28    the  Child Protection Fund as created by this Section and $60
29    shall be  deposited  into  the  Secretary  of  State  Special

 1    License Plate Fund to be used by the Secretary to help defray
 2    the  administrative  processing costs.  For each registration
 3    renewal period a $75 fee,  in  addition  to  the  appropriate
 4    registration  fee,  shall be charged.  Of this fee, $25 shall
 5    be deposited into the Child Protection Fund and $50 shall  be
 6    deposited  into  the Secretary of State Special License Plate
 7    Fund.
 8        (d)  The Child Protection Fund is created  as  a  special
 9    fund   in  the  State  treasury.   All  money  in  the  Child
10    Protection Fund shall be paid, subject  to  appropriation  by
11    the General Assembly and approval by the Secretary, as grants
12    to   Illinois  hospitals  providing  pediatric  care.   These
13    hospitals shall apply for these grants through the  Secretary
14    in a manner and form as prescribed by the Secretary.
15        (e)  There  is created the Child Protection Fund Advisory
16    Panel consisting of one member appointed by the Governor, one
17    member appointed by the Speaker  of  the  House,  one  member
18    appointed  by  the  Minority  Leader of the House, one member
19    appointed by the President of  the  Senate,  and  one  member
20    appointed  by  the Minority Leader of the Senate, all of whom
21    shall serve without compensation.  The Panel shall meet twice
22    a year to consider  the  grant  applications  made  by  these
23    hospitals  and  make  recommendations  to  the  Secretary  on
24    whether   or   not  the  Secretary  should  approve  a  grant
25    application.  The Secretary shall make the final decision  on
26    whether or not to approve a grant application.
