LRB9002775NTsb SB361 Enrolled LRB9002775NTsb 1 AN ACT to amend the Probate Act of 1975 by changing 2 Section 25-2. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Probate Act of 1975 is amended by 6 changing Section 25-2 as follows: 7 (755 ILCS 5/25-2) (from Ch. 110 1/2, par. 25-2) 8 Sec. 25-2. When appointment of representative of ward 9 unnecessary.) Upon receiving an affidavit that the personal 10 estate of a ward does not exceed $10,000$5,000in value, 11 that no representative has been appointed for his estate and 12 that the affiant is a parent or a person standing in loco 13 parentis to the minor or is the spouse of the ward or, if 14 there is no spouse of the ward, that affiant is a relative 15 having the responsibility of the support of the person under 16 legal disability or ward, any person or corporation indebted 17 to or holding personal estate of the ward may pay the amount 18 of the indebtedness or deliver the personal estate to the 19 affiant. In the same manner and upon like proof, any person 20 or corporation having the responsibility for the issuance or 21 transfer of stocks, bonds or other personal estate may issue 22 or transfer the stocks, bonds or other personal estate to or 23 in the name of the affiant. Upon the payment, delivery, 24 transfer or issuance pursuant to the affidavit, the person or 25 corporation is released to the same extent as if the payment, 26 delivery, transfer or issuance had been made to the legally 27 qualified representative of the ward and is not required to 28 see to the application or disposition of the property. 29 (Source: P.A. 83-706.) 30 Section 99.
