      50 ILCS 135/10            from Ch. 85, par. 7610
          Amends the Local Governmental Employees Political  Rights
      Act.   Requires a sheriff's office employee, who runs for the
      office of Sheriff against an  incumbent  Sheriff  or  another
      member  of  the  sheriff's office, to take an unpaid leave of
      absence during the period of time between filing the petition
      for  nomination  and  the  date  of  the  general   election.
      Effective immediately.

 1        AN   ACT   to  amend  the  Local  Governmental  Employees
 2    Political Rights Act by changing Section 10.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.  The  Local  Governmental Employees Political
 6    Rights Act is amended by changing Section 10 as follows:
 7        (50 ILCS 135/10) (from Ch. 85, par. 7610)
 8        Sec. 10.  Political rights protected.
 9        (a)  No unit of local government or school  district  may
10    make  or  enforce  any  rule  or  ordinance  that  in any way
11    inhibits or prohibits any of its  employees  from  exercising
12    the employee's political rights.
13        (b)  No  employee of a unit of local government or school
14    district  may  (i)  use  his  or  her  official  position  of
15    employment to coerce or inhibit others in the  free  exercise
16    of  their  political  rights  or  (ii)  engage  in  political
17    activities while at work or on duty.
18        (c)  A  sheriff's office employee who runs for the office
19    of Sheriff against an incumbent Sheriff or another member  of
20    the  sheriff's  office  must  take an unpaid leave of absence
21    during the period of time between  filing  the  petition  for
22    nomination and the date of the general election.

24        Section  99.  Effective date.  This Act takes effect upon
25    becoming law.
