Amend Senate Bill 781 on page 3, by 3 replacing lines 2 through 5 with the following: 4 "having receivedsuchimmunizations against the following 5 preventable communicable diseases: diphtheria, pertussis, 6 tetanus, poliomyelitis, measles, rubella, mumps, and 7 haemophilus influenzae type b. These immunizations shall be 8 given in the manner and at the times prescribed byasthe 9 Department of Public Health by rule. The Department of 10 Public Health does not have the authority to require 11 immunization of children against other diseases.shall12require by rules and regulations promulgated pursuant to this13Section and the Communicable Disease Prevention Act."; and 14 on page 5, by inserting below line 18 the following: 15 "Section 10. The Communicable Disease Prevention Act is 16 amended by changing Section 2 as follows: 17 (410 ILCS 315/2) (from Ch. 111 1/2, par. 22.12) 18 Sec. 2. The Department of Public Health shall promulgate 19 rules and regulations requiring immunization of children 20 against the preventable communicable diseases designated in 21 subsection (3) of Section 27-8.1 of the School Codeby the-2- LRB9003403EGfgam01 1Director. Before any regulation or amendment thereto is 2 prescribed, the Department shall conduct a public hearing 3 regarding such regulation. The Department may recommend to 4 the General Assemblyprescribe additional rules and5regulations forimmunization forofother diseases as 6 vaccines are developed. 7 The provisions of this Act shall not apply if: 8 1. The parent or guardian of the child objects thereto 9 on the grounds that the administration of immunizing agents 10 conflicts with his religious tenets or practices or, 11 2. A physician employed by the parent or guardian to 12 provide care and treatment to the child states that the 13 physical condition of the child is such that the 14 administration of one or more of the required immunizing 15 agents would be detrimental to the health of the child. 16 (Source: P.A. 85-828.) 17 Section 99. Effective date. This Act takes effect upon 18 becoming law.".
