Amend Senate Bill 1120, AS AMENDED, 3 by replacing the title with the following: 4 "AN ACT in relation to local government"; and 5 by replacing everything after the enacting clause with the 6 following: 7 "Section 5. The Counties Code is amended by adding 8 Section 5-1096.1 as follows: 9 (55 ILCS 5/5-1096.1 new) 10 Sec. 5-1096.1. Fees; delinquent payment for cable 11 television service. A fee shall not be imposed on consumers 12 for any delinquent payment for the sale of cable television 13 service unless all of the following apply: 14 (1) the consumer has first been provided with 15 written notice that it is the policy of the seller to 16 impose a fee on delinquent accounts; 17 (2) at least 10 days before the date a fee is 18 imposed, the consumer is warned on the face of the 19 notice, in writing, of the late fee that will be imposed 20 if a consumer's delinquency is not paid; this notice 21 shall specify the date on or after which a late fee will -2- LRB9003548PTcwam06 1 be charged; 2 (3) the consumer's invoice specifies a due date 3 that is no earlier than 10th day of the service period 4 for which the invoice is issued; 5 (4) the fee is assessed no earlier than 30 days 6 after the due date specified in the invoice; and 7 (5) the fee is assessed on a delinquent balance of 8 more than $10. 9 A delinquency fee charged in a cable television 10 transaction that is not more than $5 and that is imposed in 11 accordance with items (1) through (5) of this Section shall 12 be valid and reasonable. 13 A collection fee that is not more than $10 and that is in 14 addition to the delinquency fee shall also be valid and 15 reasonable in a cable television transaction if the service 16 provider sends an employee or contractor to the consumer's 17 residence in order to collect payment or disconnect service 18 and if the fee is imposed in accordance with items (1) 19 through (5) of this Section. 20 Section 10. The Illinois Municipal Code is amended by 21 adding Section 11-42-11.5 as follows: 22 (65 ILCS 5/11-42-11.5 new) 23 Sec. 11-42-11.5. Fees; delinquent payment for cable 24 television service.
