Provides exceptions from voter registration record card requirements for election authorities employing computer-based voter registration files. Requires that the voting record of a voter seeking cancellation of his or her registration be retained for 5 years. Eliminates presentation of a voter's triplicate card, or affidavit of cancellation, as a means of transferring voter registration to a different election jurisdiction. Eliminates an affidavit of cancellation as a means of transferring a voter's registration within the same election jurisdiction. Effective immediately. LRB9007470JMgcA LRB9007470JMgcA 1 AN ACT to amend the Election Code by changing Sections 2 4-8, 4-8.03, 5-7, 5-7.03, 6-35, and 6-35.03. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Election Code is amended by changing 6 Sections 4-8, 4-8.03, 5-7, 5-7.03, 6-35, and 6-35.03 as 7 follows: 8 (10 ILCS 5/4-8) (from Ch. 46, par. 4-8) 9 Sec. 4-8. The county clerk shall provide a sufficient 10 number of blank forms for the registration of electors, which 11 shall be known as registration record cards and which shall 12 consist of loose leaf sheets or cards, of suitable size to 13 contain in plain writing and figures the data hereinafter 14 required thereon or shall consist of computer cards of 15 suitable nature to contain the data required thereon. The 16 registration record cards, which shall include an affidavit 17 of registration as hereinafter provided, shall be executed in 18 duplicate. 19 The registration record card shall contain the following 20 and such other information as the county clerk may think it 21 proper to require for the identification of the applicant for 22 registration: 23 Name. The name of the applicant, giving surname and first 24 or Christian name in full, and the middle name or the initial 25 for such middle name, if any. 26 Sex. 27 Residence. The name and number of the street, avenue, or 28 other location of the dwelling, including the apartment, unit 29 or room number, if any, and in the case of a mobile home the 30 lot number, and such additional clear and definite 31 description as may be necessary to determine the exact -2- LRB9007470JMgcA 1 location of the dwelling of the applicant. Where the location 2 cannot be determined by street and number, then the section, 3 congressional township and range number may be used, or such 4 other description as may be necessary, including post-office 5 mailing address. In the case of a homeless individual, the 6 individual's voting residence that is his or her mailing 7 address shall be included on his or her registration record 8 card. 9 Term of residence in the State of Illinois and precinct. 10 This information shall be furnished by the applicant stating 11 the place or places where he resided and the dates during 12 which he resided in such place or places during the year next 13 preceding the date of the next ensuing election. 14 Nativity. The state or country in which the applicant was 15 born. 16 Citizenship. Whether the applicant is native born or 17 naturalized. If naturalized, the court, place, and date of 18 naturalization. 19 Date of application for registration, i. e., the day, 20 month and year when applicant presented himself for 21 registration. 22 Age. Date of birth, by month, day and year. 23 Physical disability of the applicant, if any, at the time 24 of registration, which would require assistance in voting. 25 The county and state in which the applicant was last 26 registered. 27 Signature of voter. The applicant, after the registration 28 and in the presence of a deputy registrar or other officer of 29 registration shall be required to sign his or her name in ink 30 to the affidavit on both the original and duplicate 31 registration record cards. 32 Signature of deputy registrar or officer of registration. 33 In case applicant is unable to sign his name, he may 34 affix his mark to the affidavit. In such case the officer -3- LRB9007470JMgcA 1 empowered to give the registration oath shall write a 2 detailed description of the applicant in the space provided 3 on the back or at the bottom of the card or sheet; and shall 4 ask the following questions and record the answers thereto: 5 Father's first name. 6 Mother's first name. 7 From what address did the applicant last register? 8 Reason for inability to sign name. 9 Each applicant for registration shall make an affidavit 10 in substantially the following form: 11 AFFIDAVIT OF REGISTRATION 12 STATE OF ILLINOIS 13 COUNTY OF....... 14 I hereby swear (or affirm) that I am a citizen of the 15 United States; that on the date of the next election I shall 16 have resided in the State of Illinois and in the election 17 precinct in which I reside 30 days and that I intend that 18 this location shall be my residence; that I am fully 19 qualified to vote, and that the above statements are true. 20 .............................. 21 (His or her signature or mark) 22 Subscribed and sworn to before me this.... day of...., 23 19... 24 .................................. 25 Signature of registration officer. (To be signed in 26 presence of registrant.) 27 Space shall be provided upon the face of each 28 registration record card for the notation of the voting 29 record of the person registered thereon, provided that an 30 election authority employing a computer-based voter 31 registration file as provided in Section 4-33 may store the 32 voting record electronically. 33 Each registration record card shall be numbered according 34 to precincts, and may be serially or otherwise marked for -4- LRB9007470JMgcA 1 identification in such manner as the county clerk may 2 determine. 3 The registration cards shall be deemed public records and 4 shall be open to inspection during regular business hours, 5 except during the 28 days immediately preceding any election. 6 On written request of any candidate or objector or any person 7 intending to object to a petition, the election authority 8 shall extend its hours for inspection of registration cards 9 and other records of the election authority during the period 10 beginning with the filing of petitions under Sections 7-10, 11 8-8, 10-6 or 28-3 and continuing through the termination of 12 electoral board hearings on any objections to petitions 13 containing signatures of registered voters in the 14 jurisdiction of the election authority. The extension shall 15 be for a period of hours sufficient to allow adequate 16 opportunity for examination of the records but the election 17 authority is not required to extend its hours beyond the 18 period beginning at its normal opening for business and 19 ending at midnight. If the business hours are so extended, 20 the election authority shall post a public notice of such 21 extended hours. Registration record cards may also be 22 inspected, upon approval of the officer in charge of the 23 cards, during the 28 days immediately preceding any election. 24 Registration record cards shall also be open to inspection by 25 certified judges and poll watchers and challengers at the 26 polling place on election day, but only to the extent 27 necessary to determine the question of the right of a person 28 to vote or to serve as a judge of election. At no time shall 29 poll watchers or challengers be allowed to physically handle 30 the registration record cards. 31 Updated copies of computer tapes or computer discs or 32 other electronic data processing information containing voter 33 registration information shall be furnished by the county 34 clerk within 10 days after December 15 and May 15 each year -5- LRB9007470JMgcA 1 to the State Board of Elections in a form prescribed by the 2 Board. Registration information shall include, but not be 3 limited to, the following information: name, sex, residence, 4 telephone number, if any, age, party affiliation, if 5 applicable, precinct, ward, township, county, and 6 representative, legislative and congressional districts. In 7 the event of noncompliance, the State Board of Elections is 8 directed to obtain compliance forthwith with this 9 nondiscretionary duty of the election authority by 10 instituting legal proceedings in the circuit court of the 11 county in which the election authority maintains the 12 registration information. The costs of furnishing updated 13 copies of tapes or discs shall be paid at a rate of $.00034 14 per name of registered voters in the election jurisdiction, 15 but not less than $50 per tape or disc and shall be paid from 16 appropriations made to the State Board of Elections for 17 reimbursement to the election authority for such purpose. The 18 Board shall furnish copies of such tapes, discs, other 19 electronic data or compilations thereof to state political 20 committees registered pursuant to the Illinois Campaign 21 Finance Act or the Federal Election Campaign Act at their 22 request and at a reasonable cost. Copies of the tapes, discs 23 or other electronic data shall be furnished by the county 24 clerk to local political committees at their request and at a 25 reasonable cost. Reasonable cost of the tapes, discs, et 26 cetera for this purpose would be the cost of duplication plus 27 15% for administration. The individual representing a 28 political committee requesting copies of such tapes shall 29 make a sworn affidavit that the information shall be used 30 only for bona fide political purposes, including by or for 31 candidates for office or incumbent office holders. Such 32 tapes, discs or other electronic data shall not be used under 33 any circumstances by any political committee or individuals 34 for purposes of commercial solicitation or other business -6- LRB9007470JMgcA 1 purposes. If such tapes contain information on county 2 residents related to the operations of county government in 3 addition to registration information, that information shall 4 not be used under any circumstances for commercial 5 solicitation or other business purposes. The prohibition in 6 this Section against using the computer tapes or computer 7 discs or other electronic data processing information 8 containing voter registration information for purposes of 9 commercial solicitation or other business purposes shall be 10 prospective only from the effective date of this amended Act 11 of 1979. Any person who violates this provision shall be 12 guilty of a Class 4 felony. 13 The State Board of Elections shall promulgate, by October 14 1, 1987, such regulations as may be necessary to ensure 15 uniformity throughout the State in electronic data processing 16 of voter registration information. The regulations shall 17 include, but need not be limited to, specifications for 18 uniform medium, communications protocol and file structure to 19 be employed by the election authorities of this State in the 20 electronic data processing of voter registration information. 21 Each election authority utilizing electronic data processing 22 of voter registration information shall comply with such 23 regulations on and after May 15, 1988. 24 If the applicant for registration was last registered in 25 another county within this State, he shall also sign a 26 certificate authorizing cancellation of the former 27 registration. The certificate shall be in substantially the 28 following form: To the County Clerk of.... County, Illinois. 29 To the Election Commission of the City of...., Illinois. 30 This is to certify that I am registered in your (county) 31 (city) and that my residence was ............................ 32 Having moved out of your (county) (city), I hereby authorize 33 you to cancel said registration in your office. 34 Dated at...., Illinois, this.... day of...., 19... -7- LRB9007470JMgcA 1 ................................. 2 (Signature of Voter) 3 Attest:................, County Clerk,..................... 4 County, Illinois. 5 The cancellation certificate shall be mailed immediately 6 by the County Clerk to the County Clerk (or election 7 commission as the case may be) where the applicant was 8 formerly registered. Receipt of such certificate shall be 9 full authority for cancellation of any previous registration, 10 except that the applicant's voting record shall be retained 11 for 5 years. 12 (Source: P.A. 86-873; 86-1348; 87-1241.) 13 (10 ILCS 5/4-8.03) (from Ch. 46, par. 4-8.03) 14 Sec. 4-8.03. The State Board of Elections shall design a 15 registration record card which, except as otherwise provided 16 in this Code for election authorities employing a 17 computer-based voter registration file as provided in Section 18 4-33Section, shall be used in triplicate by all election 19 authorities in the State, beginning with registrations taken 20 on or after January 1, 1986. The Board shall prescribe the 21 form and specifications, including but not limited to the 22 weight of paper, color and print of such cards. Such cards 23 shall contain boxes or spaces for the information required 24 under Sections 4-8 and 4-21 of this Code; provided, that such 25 cards shall also contain a box or space for the applicant's 26 driver's license number, or where allowable the applicant's 27 social security number, if any, and a box for the applicant's 28 telephone number, if available. 29 The original and duplicate cards shall respectively 30 constitute the master file and precinct binder registration 31 records of the voter. The triplicate card shall be given to 32 the applicant upon completion of his or her registration or 33 completed transfer of registration. -8- LRB9007470JMgcA 1 Whenever a voter moves to another precinct within the 2 same election jurisdictionor to another election3jurisdiction in the State, such voter may transfer his or her 4 registration by presenting his or her triplicate card to the 5 election authority or a deputy registrar.If such voter is6not in possession of or has lost his or her triplicate card,7he or she may effect a transfer of registration by executing8an Affidavit of Cancellation of Previous Registration.9In the case of a transfer of registration to a new10election jurisdiction, the election authority shall transmit11the voter's triplicate card or such affidavit to the election12authority of the voter's former election jurisdiction, which13shall immediately cause the transmission of the voter's14previous registration card to the voter's new election15authority. No transfer of registration to a new election16jurisdiction shall be complete until the voter's old election17authority receives notification.18 Deputy registrars shall return all triplicate cards or 19 Affidavits of Cancellation of Previous Registration to the 20 election authority within 7 working days after the receipt 21 thereof, except that such cards or Affidavits of Cancellation 22 of Previous Registration received by the deputy registrars 23 between the 35th and 28th day preceding an election shall be 24 returned by the deputy registrars to the election authority 25 within 48 hours after receipt. The deputy registrars shall 26 return the cards or Affidavits of Cancellation of Previous 27 Registration received by them on the 28th day preceding an 28 election to the election authority within 24 hours after 29 receipt thereof. 30 The date by which an election authority is required to 31 take registrations in compliance with this Section may be 32 extended by the State Board of Elections to a date no later 33 than July 1, 1986, where, prior to January 1, 1986, the Board 34 has received a written request for such an extension from the -9- LRB9007470JMgcA 1 election authority and such request has shown good cause for 2 the extension. 3 (Source: P.A. 86-873.) 4 (10 ILCS 5/5-7) (from Ch. 46, par. 5-7) 5 Sec. 5-7. The registration record cards, which 5 shall include an affidavit of registration as hereinafter 6 provided, shall be executed in duplicate. The duplicate of 7 which may be a carbon copy of the original or a copy of the 8 original made by the use of other method or material used for 9 making simultaneous true copies or duplications. 10 The registration record card shall contain the following 11 and such other information as the Board of Election 12 Commissioners may think it proper to require for the 13 identification of the applicant for registration: 14 Name. The name of the applicant, giving surname and first 15 or Christian name in full, and the middle name or the initial 16 for such middle name, if any. 17 Sex. 18 Residence. The name and number of the street, avenue, or 19 other location of the dwelling, including the apartment, unit 20 or room number, if any, and in the case of a mobile home the 21 lot number, and such additional clear and definite 22 description as may be necessary to determine the exact 23 location of the dwelling of the applicant, including 24 post-office mailing address. In the case of a homeless 25 individual, the individual's voting residence that is his or 26 her mailing address shall be included on his or her 27 registration record card. 28 Term of residence in the State of Illinois and the 29 precinct. 30 Nativity. The state or country in which the applicant was 31 born. 32 Citizenship. Whether the applicant is native born or 33 naturalized. If naturalized, the court, place, and date of 34 naturalization. -18- LRB9007470JMgcA 1 Date of application for registration, i. e., the day, 2 month and year when the applicant presented himself for 3 registration. 4 Age. Date of birth, by month, day and year. 5 Physical disability of the applicant, if any, at the time 6 of registration, which would require assistance in voting. 7 The county and state in which the applicant was last 8 registered. 9 Signature of voter. The applicant, after registration and 10 in the presence of a deputy registrar or other officer of 11 registration shall be required to sign his or her name in ink 12 to the affidavit on both the original and the duplicate 13 registration record card. 14 Signature of deputy registrar. 15 In case applicant is unable to sign his name, he may 16 affix his mark to the affidavit. In such case the 17 registration officer shall write a detailed description of 18 the applicant in the space provided at the bottom of the card 19 or sheet; and shall ask the following questions and record 20 the answers thereto: 21 Father's first name......................... 22 Mother's first name......................... 23 From what address did you last register?.... 24 Reason for inability to sign name........... 25 Each applicant for registration shall make an affidavit 26 in substantially the following form: 27 AFFIDAVIT OF REGISTRATION 28 State of Illinois ) 29 )ss 30 County of....... ) 31 I hereby swear (or affirm) that I am a citizen of the 32 United States, that on the day of the next election I shall 33 have resided in the State of Illinois and in the election 34 precinct 30 days and that I intend that this location is my -19- LRB9007470JMgcA 1 residence; that I am fully qualified to vote, and that the 2 above statements are true. 3 .............................. 4 (His or her signature or mark) 5 Subscribed and sworn to before me this.... day of...., 6 19... 7 Signature of registration officer (to be signed in 8 presence of registrant). 9 Space shall be provided upon the face of each 10 registration record card for the notation of the voting 11 record of the person registered thereon, provided that an 12 election authority employing a computer-based voter 13 registration file as provided in Section 6-79 may store the 14 voting record electronically. 15 Each registration record card shall be numbered according 16 to wards or precincts, as the case may be, and may be 17 serially or otherwise marked for identification in such 18 manner as the Board of Election Commissioners may determine. 19 The registration cards shall be deemed public records and 20 shall be open to inspection during regular business hours, 21 except during the 28 days immediately preceding any election. 22 On written request of any candidate or objector or any person 23 intending to object to a petition, the election authority 24 shall extend its hours for inspection of registration cards 25 and other records of the election authority during the period 26 beginning with the filing of petitions under Sections 7-10, 27 8-8, 10-6 or 28-3 and continuing through the termination of 28 electoral board hearings on any objections to petitions 29 containing signatures of registered voters in the 30 jurisdiction of the election authority. The extension shall 31 be for a period of hours sufficient to allow adequate 32 opportunity for examination of the records but the election 33 authority is not required to extend its hours beyond the 34 period beginning at its normal opening for business and -20- LRB9007470JMgcA 1 ending at midnight. If the business hours are so extended, 2 the election authority shall post a public notice of such 3 extended hours. Registration record cards may also be 4 inspected, upon approval of the officer in charge of the 5 cards, during the 28 days immediately preceding any election. 6 Registration record cards shall also be open to inspection by 7 certified judges and poll watchers and challengers at the 8 polling place on election day, but only to the extent 9 necessary to determine the question of the right of a person 10 to vote or to serve as a judge of election. At no time shall 11 poll watchers or challengers be allowed to physically handle 12 the registration record cards. 13 Updated copies of computer tapes or computer discs or 14 other electronic data processing information containing voter 15 registration information shall be furnished by the Board of 16 Election Commissioners within 10 days after December 15 and 17 May 15 each year to the State Board of Elections in a form 18 prescribed by the State Board. Registration information 19 shall include, but not be limited to, the following 20 information: name, sex, residence, telephone number, if any, 21 age, party affiliation, if applicable, precinct, ward, 22 township, county, and representative, legislative and 23 congressional districts. In the event of noncompliance, the 24 State Board of Elections is directed to obtain compliance 25 forthwith with this nondiscretionary duty of the election 26 authority by instituting legal proceedings in the circuit 27 court of the county in which the election authority maintains 28 the registration information. The costs of furnishing 29 updated copies of tapes or discs shall be paid at a rate of 30 $.00034 per name of registered voters in the election 31 jurisdiction, but not less than $50 per tape or disc and 32 shall be paid from appropriations made to the State Board of 33 Elections for reimbursement to the election authority for 34 such purpose. The State Board shall furnish copies of such -21- LRB9007470JMgcA 1 tapes, discs, other electronic data or compilations thereof 2 to state political committees registered pursuant to the 3 Illinois Campaign Finance Act or the Federal Election 4 Campaign Act at their request and at a reasonable cost. 5 Copies of the tapes, discs or other electronic data shall be 6 furnished by the Board of Election Commissioners to local 7 political committees at their request and at a reasonable 8 cost. Reasonable cost of the tapes, discs, et cetera for 9 this purpose would be the cost of duplication plus 15% for 10 administration. The individual representing a political 11 committee requesting copies of such tapes shall make a sworn 12 affidavit that the information shall be used only for bona 13 fide political purposes, including by or for candidates for 14 office or incumbent office holders. Such tapes, discs or 15 other electronic data shall not be used under any 16 circumstances by any political committee or individuals for 17 purposes of commercial solicitation or other business 18 purposes. If such tapes contain information on county 19 residents related to the operations of county government in 20 addition to registration information, that information shall 21 not be used under any circumstances for commercial 22 solicitation or other business purposes. The prohibition in 23 this Section against using the computer tapes or computer 24 discs or other electronic data processing information 25 containing voter registration information for purposes of 26 commercial solicitation or other business purposes shall be 27 prospective only from the effective date of this amended Act 28 of 1979. Any person who violates this provision shall be 29 guilty of a Class 4 felony. 30 The State Board of Elections shall promulgate, by October 31 1, 1987, such regulations as may be necessary to ensure 32 uniformity throughout the State in electronic data processing 33 of voter registration information. The regulations shall 34 include, but need not be limited to, specifications for -22- LRB9007470JMgcA 1 uniform medium, communications protocol and file structure to 2 be employed by the election authorities of this State in the 3 electronic data processing of voter registration information. 4 Each election authority utilizing electronic data processing 5 of voter registration information shall comply with such 6 regulations on and after May 15, 1988. 7 If the applicant for registration was last registered in 8 another county within this State, he shall also sign a 9 certificate authorizing cancellation of the former 10 registration. The certificate shall be in substantially the 11 following form: 12 To the County Clerk of.... County, Illinois. 13 To the Election Commission of the City of...., Illinois. 14 This is to certify that I am registered in your (county) 15 (city) and that my residence was..... Having moved out of 16 your (county), (city), I hereby authorize you to cancel that 17 registration in your office. 18 Dated at...., Illinois, this.... day of.... 19... 19 .................... 20 (Signature of Voter) 21 Attest...., Clerk, Election Commission of the City 22 of...., Illinois. 23 The cancellation certificate shall be mailed immediately 24 by the clerk of the Election Commission to the county clerk, 25 (or Election Commission as the case may be) where the 26 applicant was formerly registered. Receipt of such 27 certificate shall be full authority for cancellation of any 28 previous registration, except that the applicant's voting 29 record shall be retained for 5 years. 30 (Source: P.A. 86-873; 86-1348; 87-1241.) 31 (10 ILCS 5/6-35.03) (from Ch. 46, par. 6-35.03) 32 Sec. 6-35.03. The State Board of Elections shall design 33 a registration record card which, except as otherwise -23- LRB9007470JMgcA 1 provided in this Code for election authorities employing a 2 computer-based voter registration file as provided in Section 3 6-79Section, shall be used in triplicate by all election 4 authorities in the State, beginning with registrations taken 5 on or after January 1, 1986. The Board shall prescribe the 6 form and specifications, including but not limited to the 7 weight of paper, color and print of such cards. Such cards 8 shall contain boxes or spaces for the information required 9 under Sections 6-31.1 and 6-35 of this Code; provided, that 10 such cards shall also contain a box or space for the 11 applicant's driver's license number, or where allowable the 12 applicant's social security number, if any, and a box for the 13 applicant's telephone number, if available. 14 The original and duplicate cards shall respectively 15 constitute the master file and precinct binder registration 16 records of the voter. The triplicate card shall be given to 17 the applicant upon completion of his or her registration or 18 completed transfer of registration. 19 Whenever a voter moves to another precinct within the 20 same election jurisdictionor to another election21jurisdiction in the State, such voter may transfer his or her 22 registration by presenting his or her triplicate card to the 23 election authority or a deputy registrar.If such voter is24not in possession of or has lost his or her triplicate card,25he or she may effect a transfer of registration by executing26an Affidavit of Cancellation of Previous Registration.27In the case of a transfer of registration to a new28election jurisdiction, the election authority shall transmit29the voter's triplicate card or such affidavit to the election30authority of the voter's former election jurisdiction, which31shall immediately cause the transmission of the voter's32previous registration card to the voter's new election33authority. No transfer of registration to a new election34jurisdiction shall be complete until the voter's old election-24- LRB9007470JMgcA 1authority receives notification.2 Deputy registrars shall return all triplicate cards or 3 Affidavits of Cancellation of Previous Registration to the 4 election authority within 7 working days after the receipt 5 thereof. Such cards or Affidavits of Cancellation of Previous 6 Registration received by the deputy registrars between the 7 35th and 28th day preceding an election shall be returned by 8 the deputy registrars within 48 hours after receipt thereof. 9 Such cards or Affidavits of Cancellation of Previous 10 Registration received by the deputy registrars on the 28th 11 day preceding an election shall be returned by the deputy 12 registrars to the election authority within 24 hours after 13 receipt thereof. 14 The date by which an election authority is required to 15 take registrations in compliance with this Section may be 16 extended by the State Board of Elections to a date no later 17 than July 1, 1986, where, prior to January 1, 1986, the Board 18 has received a written request for such an extension from the 19 election authority and such request has shown good cause for 20 the extension. 21 In the case of a transfer of registration to a new 22 election jurisdiction, the election authority shall transmit 23 the voter's triplicate card or such affidavit to the election 24 authority of the voter's former election jurisdiction, which 25 shall immediately cause the transmission of the voter's 26 previous registration card to the voter's new election 27 authority. No transfer of registration to a new election 28 jurisdiction shall be complete until the voter's old election 29 authority receives notification. 30 Deputy registrars shall return all triplicate cards or 31 Affidavits of Cancellation of Previous Registration to the 32 election authority within 7 working days after the receipt 33 thereof, except that the deputy registrars shall return the 34 cards or Affidavits of Cancellation of Previous Registration -25- LRB9007470JMgcA 1 received by them between the 35th and 28th day preceding an 2 election to the election authority within 48 hours after the 3 receipt thereof. 4 Such cards or Affidavits of Cancellation of Previous 5 Registration received during the 28th day preceding an 6 election shall be returned by the deputy registrars to the 7 election authority within 24 hours after receipt thereof. 8 (Source: P.A. 86-873.) 9 Section 99.
