      305 ILCS 5/5-2.5 new
          Amends the Medical Assistance  Article  of  the  Illinois
      Public  Aid  Code.  Provides that, on and after the effective
      date of this amendatory Act  of  1998,  the  State  plan  for
      medical  assistance  shall  not  be  modified  with regard to
      eligibility  requirements  to  receive  medical   assistance,
      either  by  increasing the income eligibility level above the
      minimum required  federal  guidelines  or  by  expanding  the
      classes  of persons covered, unless the proposed modification
      is approved by joint  resolution  of  the  General  Assembly,
      regardless  of  whether  approval  by the appropriate federal
      authority has been granted.  Effective immediately.

 1        AN ACT to amend the Illinois Public Aid  Code  by  adding
 2    Section 5-2.5.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Illinois Public Aid Code  is  amended  by
 6    adding Section 5-2.5 as follows:
 7        (305 ILCS 5/5-2.5 new)
 8        Sec.  5-2.5.   Approval  by General Assembly required for
 9    expansion of medical assistance program.  On  and  after  the
10    effective  date  of  this  amendatory Act of 1998,  the State
11    plan for medical assistance under Section 5-2  of  this  Code
12    and  Titles  XIX and XXI of the Social Security Act shall not
13    be  modified  with  regard  to  eligibility  requirements  to
14    receive medical assistance, either by increasing  the  income
15    eligibility   level   above   the  minimum  required  federal
16    guidelines or by expanding the classes  of  persons  covered,
17    unless   the  proposed  modification  is  approved  by  joint
18    resolution of the General  Assembly,  regardless  of  whether
19    approval  by  the  appropriate  federal  authority  has  been
20    granted.
21        Section  99.  Effective date.  This Act takes effect upon
22    becoming law.
