Amends the Department of Human Services Act. Requires
the Department to develop and implement a Family Support
Services Pilot Project.

1 AN ACT to amend the Community Services Act by adding
2 Section 4.3.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Community Services Act is amended by
6 adding Section 4.3 as follows:
7 (405 ILCS 30/4.3 new)
8 Sec. 4.3. Family Support Services Voucher Pilot Program.
9 (a) In this Section:
10 "Family member" means a family member as defined by rules
11 adopted by the Department of Human Services.
12 "Family support services" means the services and
13 activities described in subsection (d).
14 (b) The Department of Human Services shall establish a
15 Family Support Services Voucher Pilot Program which shall be
16 a conversion of the program defined in Section 4.1. The
17 Department may establish no more than 5 pilot programs.
18 (c) The purpose of the pilot program is to do the
19 following:
20 (1) Increase the number of families who are able to
21 access family support services.
22 (2) Provide families with greater control over
23 family support services.
24 (3) Ensure that the diverse family support services
25 needs of families can be accommodated.
26 (4) Encourage a family's contribution toward
27 payment for the family support services they receive.
28 (5) Serve as a pilot program to evaluate the merits
29 of a family support services voucher program in
30 comparison to the traditional respite program.
31 (d) The Department shall contract with community

1 agencies to issue vouchers to participating families, or to
2 employ a voucher-like method that similarly makes services
3 available based on the choice of families. A family may use
4 the vouchers to purchase the following services and
5 activities or to otherwise provide for those services and
6 activities:
7 (1) Services of an in-home caregiver to supervise
8 the family member with a developmental disability in the
9 home or in the community or both when other family
10 members are not present.
11 (2) Services of a person to accompany the family
12 member with a developmental disability on outings,
13 community activities, and similar activities.
14 (3) Registration of the family member with a
15 developmental disability in park district programs,
16 extracurricular school activities, community college
17 classes, and other similar types of community-based
18 programs.
19 (4) Services of home health care personnel if
20 medical training or expertise is required to meet the
21 needs of the family member with a developmental
22 disability.
23 (e) Families may employ the following types of
24 individuals to provide family support services:
25 (1) Related family members who do not reside in the
26 same home as the family member with a developmental
27 disability.
28 (2) Friends or neighbors whom the family designates
29 as capable of meeting the needs of the family member with
30 a developmental disability.
31 (3) Individuals recruited from the community (for
32 example, church members or college students).
33 (4) Individuals who work with the family member
34 with a developmental disability in a different capacity

1 (for example, classroom aide or day program staff).
2 (5) Persons whose services are contracted for
3 through a home health agency licensed under the Home
4 Health Agency Licensing Act.
5 (f) Family support services moneys under the pilot
6 program may not be used to purchase or provide for any of the
7 following services or activities:
8 (1) Out-of-home medical services.
9 (2) Medical, therapeutic, or developmental
10 evaluations.
11 (3) Any product or item (for example, sports
12 equipment, therapeutic devices, or clothing).
13 (4) Family support services provided by a family
14 member whose primary residence is the same as that of the
15 family member with a developmental disability.
16 (5) Services of a person to accompany the family on
17 an overnight trip.
18 (6) Any service or activity that should be provided
19 by the school in which the family member with a
20 developmental disability is enrolled or that occurs as
21 part of that school's typical school routine.
22 (7) Child care services while the primary caretaker
23 works.
24 (g) The Department of Human Services shall submit a
25 report to the General Assembly by March 1, 2000 evaluating
26 the merits of the pilot program.
27 Section 99. Effective date. This Act takes effect
28 January 1, 1999.
