90_SB1842 750 ILCS 60/405 new Amends the Illinois Domestic Violence Act of 1986. From January 1, 1999 to January 1, 2000, requires specified individuals having reasonable cause to believe a person may be a victim of domestic violence to report the case of domestic violence, but not the name of the person, to the Department of State Police. Requires the Department to submit a report on the effectiveness of these provisions to the General Assembly by October 1, 1999. LRB9011303NTsbA LRB9011303NTsbA 1 AN ACT to amend the Illinois Domestic Violence Act of 2 1986 by adding Section 405. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Domestic Violence Act of 1986 is 6 amended by adding Section 405 as follows: 7 (750 ILCS 60/405 new) 8 Sec. 405. Domestic violence report. From January 1, 9 1999 to January 1, 2000, any physician, resident, intern, 10 hospital, hospital administrator, or personnel engaged in 11 examination, care, and treatment of persons, surgeon, 12 dentist, dentist hygienist, osteopath, chiropractor, 13 podiatrist, physician assistant, substance abuse treatment 14 personnel, Christian Science practitioner, funeral home 15 director or employee, coroner, medical examiner, emergency 16 medical technician, acupuncturist, crisis line or hotline 17 personnel, social worker, social services administrator, 18 domestic violence program personnel, registered nurse, 19 licensed practical nurse, law enforcement officer, 20 registered psychologist or assistant working under the direct 21 supervision of a psychologist, psychiatrist, or field 22 personnel of the Department of Public Aid, Public Health, 23 Human Services, Corrections, Human Rights, or Children and 24 Family Services, supervisor or administrator of general 25 assistance under the Illinois Public Aid Code, or probation 26 officer having reasonable cause to believe a person known to 27 him or her in his or her professional or official capacity 28 may be a victim of domestic violence shall immediately report 29 the case of domestic violence, but not the name of the 30 person, or cause a report to be made to the Department of 31 State Police on a form provided by the Department of State -2- LRB9011303NTsbA 1 Police. From January 1, 1999 to January 1, 2000, the 2 privileged quality of communication between any professional 3 person required to report a case of domestic violence under 4 this Section and his or her patient or client shall not apply 5 to situations involving domestic violence, except for the 6 patient's or client's name, and shall not constitute grounds 7 for failure to report as required by this Section. The 8 Department of State Police shall submit a report on the 9 effectiveness of this Section to the General Assembly by 10 October 1, 1999.
