Provides that the governing board of a school district located in a county having a population of 500,000 or more and less than 3,000,000 may submit to the county board a written request that a meeting be held to discuss school land and capital facilities donations from a developer of a subdivision or resubdivision. Effective immediately. SENATE AMENDMENT NO. 1. Deletes reference to: 55 ILCS 5/5-1041.2 new Deletes everything. Amends the Counties Code. Provides that the county board may prescribe reasonable rules and regulations governing the provision of necessary capital facilities for schools in any map, plat, or subdivision of any parcel of land. Provides that the governing body of a school district that is located in a county having a population of less than 3,000,000 may submit to the county board a written request that a meeting be held to discuss school land donations, capital facilities donations, or both (now school land donations) from a developer of a subdivision or resubdivision of land included within the area served by the school district. Provides that the donation shall not exceed the developer's proportionate share of the costs to a school district that are specifically and uniquely attributable to the subdivision or resubdivision. Provides that a county must use a consistent and accurate formula in determining a developer's proportionate share. Provides that donations not used for school purposes within 10 years from the date of final plat approval shall be returned to the party who made the donation. Provides that capital facilities donations shall not be used to cure existing deficiencies in a school.
