1 AMENDMENT TO HOUSE BILL 1863
2 AMENDMENT NO. . Amend House Bill 1863 on page 2, by
3 replacing lines 15 through 22 with the following:
4 "The facility director of the Chester Mental Health
5 Center may authorize the temporary use of handcuffs on a
6 recipient for a period not to exceed 10 minutes when
7 necessary in the course of transport of the recipient within
8 the facility to maintain custody or security. Use of
9 handcuffs is subject to the provisions of Section 2-108 of
10 the Mental Health and Developmental Disabilities Code. The
11 facility shall keep a monthly record listing each instance in
12 which handcuffs are used, circumstances indicating the need
13 for use of handcuffs, and time of application of handcuffs
14 and time of release therefrom. The facility director shall
15 allow the Illinois Guardianship and Advocacy Commission, the
16 agency designated by the Governor under Section 1 of the
17 Protection and Advocacy for Developmentally Disabled Persons
18 Act, and the Department to examine and copy such record upon
19 request.".
