PHILIP-WEAVER,S. New Act 815 ILCS 705/Act rep. Creates the Illinois Franchise and Distributorship Act. Provides that a franchise or distributorship imposes a duty of good faith on the parties. Provides that no franchisor, supplier, or distributor may cancel, fail to renew, otherwise terminate, or alter an agreement unless the party intending that action has good cause to do so, has made good faith efforts to resolve disagreements, and, if notice is required, provided proper notice and the affected party has not eliminated the reasons specified in the notification within 90 days. Provides that a violation of the Act with intent to defraud is a Class 2 felony.
