Senate Sponsors: MOLARO Short description: ENVIRONMENTAL PRO-SCHOOLS Synopsis of Bill as introduced: Amends the School Code to make a technical change to a Section concerning notes. HOUSE AMENDMENT NO. 1. Deletes reference to: 105 ILCS 5/34B-3 Adds reference to: 105 ILCS 5/10-20.31 new 105 ILCS 5/34-18.18 new Deletes everything. Amends the School Code to require a school board to have any cleanup conducted at a school construction site conducted in accordance with standards set by the Environmental Protection Agency and to obtain the approval of the Environmental Protection Agency for the cleanup. Prohibits the board from proceeding with construction at the site until any cleanup is conducted in accordance with standards set by the Environmental Protection Agency. Requires the board to obtain a copy of the Environmental Protection Agency report concerning the site before proceeding with construction at the site. Effective July 1, 1999. Prohibits a person from commencing construction on real property of a building intended for use as an educational facility for children 18 years of age or younger unless (i) a Phase 1 Environmental Audit is obtained, (ii) a Phase II Environmental Audit is obtained if the Phase 1 Environmental Audit discloses the presence or likely presence of a release or a substantial threat of a release of a regulated substance at, on, to, or from the real property, and (iii) the real property is enrolled in the Site Remediation Program and remedial action that the Agency approves for the intended use of the property is completed if the Phase II Environmental Audit discloses the presence or likely presence of a release or a substantial threat of a release.
