91_HB2023enr HB2023 Enrolled LRB9104508NTsb 1 AN ACT to amend the Environmental Protection Act by 2 adding Section 58.15. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Environmental Protection Act is amended 6 by adding Section 58.15 as follows: 7 (415 ILCS 5/58.15 new) 8 Sec. 58.15. Construction of school; requirements. This 9 Section applies only to counties with a population of more 10 than 3,000,000. In this Section, "school" means a school as 11 defined in Section 34-1.1 of the School Code. No person 12 shall commence construction on real property of a building 13 intended for use as a school unless: 14 (1) a Phase 1 Environmental Audit, conducted in 15 accordance with Section 22.2 of this Act, is obtained; 16 (2) if the Phase 1 Environmental Audit discloses 17 the presence or likely presence of a release or a 18 substantial threat of a release of a regulated substance 19 at, on, to, or from the real property, a Phase II 20 Environmental Audit, conducted in accordance with Section 21 22.2 of this Act, is obtained; and 22 (3) if the Phase II Environmental Audit discloses 23 the presence or likely presence of a release or a 24 substantial threat of a release of a regulated substance 25 at, on, to, or from the real property, the real property 26 is enrolled in the Site Remediation Program and remedial 27 action that the Agency approves for the intended use of 28 the property is completed.
