 1                     AMENDMENT TO HOUSE BILL 333

 2        AMENDMENT NO.     .  Amend House Bill  333  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.   The  Code of Civil Procedure is amended by
 5    changing Section 7-103 as follows:

 6        (735 ILCS 5/7-103) (from Ch. 110, par. 7-103)
 7        Sec. 7-103.  "Quick-take".
 8        (a)  This Section applies only to proceedings under  this
 9    Article  that  are  authorized in the Sections following this
10    Section and preceding Section 7-104.
11        (a-5)  On and after the effective date of this amendatory
12    Act of the 92nd General Assembly, a unit of local  government
13    that  acquires  property  in  a  proceeding  subject  to this
14    Section may not thereafter transfer the  property,  by  sale,
15    lease, or otherwise, to a private individual or entity.
16        (a-10)  A   unit   of   local   government  may  exercise
17    "quick-take" powers to acquire real property or  an  interest
18    in real property under this Article only with respect to real
19    property   lying   within   the  limits  of  its  territorial
20    jurisdiction. Before the General Assembly  may  consider  any
21    amendment  of  this  Section that adds an authorization for a
22    unit of local government  to  acquire  real  property  or  an

 1    interest  in  real  property  under  this Section, all of the
 2    following must occur:
 3             (1)  The  governing  body  of  the  unit  of   local
 4        government  shall hold at least one public hearing on the
 5        matter of the proposed acquisition.  The  governing  body
 6        must  give  notice  of  the  hearing  by publication in a
 7        newspaper  published   in   the   territory   under   the
 8        jurisdiction  of  the  unit of local government or, if no
 9        newspaper is published in that territory, in a  newspaper
10        of general circulation in that territory.  At the hearing
11        the  governing  body  shall give members of the public an
12        opportunity to ask questions and offer comments orally or
13        in writing or both.
14             (2)  After the  conclusion  of  the  public  hearing
15        process required under paragraph (1), and not on the same
16        day  as  a  hearing  conducted  under that paragraph, the
17        governing body of the  unit  of  local  government  shall
18        adopt   by  recorded  vote  a  resolution  requesting  an
19        authorization to exercise "quick-take" powers to  acquire
20        the property or interest in property under this Article.
21             (3)  After  adopting  a  resolution  under paragraph
22        (2), the governing body of the unit of  local  government
23        shall file with the Secretary of the Senate and the Clerk
24        of the House of Representatives all of the following:
25                  (A)  A copy of the resolution.
26                  (B)  The  legal  description of the property or
27             interest in property sought to be  acquired  by  the
28             exercise of "quick-take" powers under this Article.
29                  (C)  An  appraisal  of the fair market value of
30             the property or interest in property  sought  to  be
31             acquired  by  the  unit  of  local  government.  The
32             appraisal  must  be  prepared  by   an   independent
33             qualified real estate appraiser.
34                  (D)  An explanation of the public purposes that

 1             the  unit  of local government intends to further by
 2             the acquisition  of  the  property  or  interest  in
 3             property.
 4        This  subsection (a-10) applies only to authorizations to
 5    acquire real property or an interest in real  property  under
 6    this  Section  that  take  effect after the effective date of
 7    this amendatory Act of the 92nd General Assembly.

17        effective date of this amendatory Act of the 91st General

19        all  the  right  of  way  needed  for the subject project
20        starting at Wernsing  Avenue  and  running  northerly  to
21        Fayette   Avenue,  including  the  right  of  way  for  a
22        structure over the CSX rail line and U. S. Route 40;
23             (75)  for  a  period  of  one  year  following   the
24        effective date of this amendatory Act of the 91st General
25        Assembly, by the City of Effingham for the acquisition of
26        property  for  the  construction  of  South  Raney Street
27        Project Phase  II,  including  a  grade  separation  over
28        Conrail and U. S. Route 40 in the City of Effingham, from
29        the  intersection of South Raney Street and West Wernsing
30        Avenue northerly  to  the  intersection  of  South  Raney
31        Street and West Fayette Avenue;
32             (76) for a period of 2 years following the effective
33        date of this amendatory Act of the 91st General Assembly,
34        by  the  Village  of  Lincolnshire,  for  the  purpose of

 8        AND   THE   NORTHERLY  LINE  OF  HALF  DAY  ROAD;  THENCE

 4        (b)  In   a  proceeding  subject  to  this  Section,  the
 5    plaintiff, at any time after the complaint has been filed and
 6    before judgment is entered in  the  proceeding,  may  file  a
 7    written  motion  requesting  that,  immediately  or  at  some
 8    specified later date, the plaintiff either be vested with the
 9    fee   simple  title  (or  such  lesser  estate,  interest  or
10    easement, as may  be  required)  to  the  real  property,  or
11    specified  portion  thereof,  which  is  the  subject  of the
12    proceeding, and be authorized to take possession of  and  use
13    such  property;  or  only be authorized to take possession of
14    and to use such property, if such possession and use, without
15    the vesting of title, are sufficient to permit the  plaintiff
16    to  proceed with the project until the final ascertainment of
17    compensation; however, no land or interests  therein  now  or

30    the  motion  relates  and the estate or interest sought to be
31    acquired therein; (2) the formally adopted schedule  or  plan
32    of  operation  for  the execution of the plaintiff's project;
33    (3) the  situation  of  the  property  to  which  the  motion
34    relates,  with  respect  to  the  schedule  or  plan; (4) the

 6    controlled or operated and used  by,  or  necessary  for  the
 7    actual  operation  of, any interstate common carrier or other
 8    public utility subject to the jurisdiction  of  the  Illinois
 9    Commerce  Commission,  a  statement  to  the  effect that the
10    approval of such proposed taking has been secured  from  such
11    Commission,  and attaching to such motion a certified copy of
12    the order of such Commission granting such approval.  If  the
13    schedule  or  plan of operation is not set forth fully in the
14    motion, a copy of such schedule or plan shall be attached  to
15    the motion.
