92_HB0447eng HB0447 Engrossed LRB9203755ARsb 1 AN ACT concerning guide dogs. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Guide Dog Access Act is amended by 5 changing Section 1 as follows: 6 (720 ILCS 630/1) (from Ch. 38, par. 65-1) 7 Sec. 1. When a blind, hearing impaired or physically 8 handicapped person is accompanied by a dog which serves as a 9 guide or leader for such person or when a trainer of a guide 10 or leader dog is accompanied by a guide or leader dog or a 11 dog that is being trained to be a guide or leader dog, 12 neither theblind, hearing impaired or physically handicapped13 person nor the dog shall be denied the right of entry and use 14 of facilities of any public place of accommodation as defined 15 in Section 5-101 of the "Illinois Human Rights Act", if such 16 dog is wearing a harness and such person presents credentials 17 for inspection issued by a school for training guide dogs. 18 Any violation of this Act is a Class C misdemeanor. 19 (Source: P.A. 83-93.) 20 Section 10. The White Cane Law is amended by changing 21 Section 3 as follows: 22 (775 ILCS 30/3) (from Ch. 23, par. 3363) 23 Sec. 3. The blind, the visually handicapped, the hearing 24 impaired and the otherwise physically disabled have the same 25 right as the able-bodied to the full and free use of the 26 streets, highways, sidewalks, walkways, public buildings, 27 public facilities and other public places. 28 The blind, the visually handicapped, the hearing impaired 29 and the otherwise physically disabled are entitled to full HB0447 Engrossed -2- LRB9203755ARsb 1 and equal accommodations, advantages, facilities and 2 privileges of all common carriers, airplanes, motor vehicles, 3 railroad trains, motor buses, street cars, boats or any other 4 public conveyances or modes of transportation, hotels, 5 lodging places, places of public accommodation, amusement or 6 resort and other places to which the general public is 7 invited, subject only to the conditions and limitations 8 established by law and applicable alike to all persons. 9 Every totally or partially blind, hearing impaired or 10 otherwise physically disabled person or a trainer of support 11 dogs, guide dogs, or hearing dogs shall have the right to be 12 accompanied by a support dog or guide dog,especially trained 13 for the purpose, or a dog that is being trained to be a 14 support dog, guide dog, or hearing dog, in any of the places 15 listed in this Section without being required to pay an extra 16 charge for the guide, support or hearing dog; provided that 17 he shall be liable for any damage done to the premises or 18 facilities by such dog. 19 (Source: P.A. 83-93.)
