 1                     AMENDMENT TO HOUSE BILL 854

 2        AMENDMENT NO.     .  Amend House Bill 854, AS AMENDED, by
 3    replacing everything  after  the  enacting  clause  with  the
 4    following:

 5        "Section  5.   The  Department of Veterans Affairs Act is
 6    amended by changing Section 2.01 as follows:

 7        (20 ILCS 2805/2.01) (from Ch. 126 1/2, par. 67.01)
 8        Sec. 2.01. Any honorably discharged veteran or  honorably
 9    discharged  former  member of the armed forces is entitled to
10    admission to an Illinois Veterans Home, if the applicant:
11        (a) (1)  Has served in the armed  forces  of  the  United
12    States  at least 1 day in the Spanish American War, World War
13    I, World War II, the Korean Conflict, the Viet Nam  Campaign,
14    or  the Persian Gulf Conflict between the dates recognized by
15    the U.S. Department of Veterans Affairs or between any  other
16    present  or future dates recognized by the U.S. Department of
17    Veterans Affairs as a war period, or has served in a  hostile
18    fire  environment  and  has  been  awarded  a  campaign or an
19    expeditionary  medal  signifying  his  or  her  service,  for
20    purposes of eligibility for domiciliary or nursing home care;
21    or
22        (2)  Has served on active duty in the  armed  forces  for

 1    one  year  for  purposes  of eligibility for domiciliary care
 2    only; and
 3        (b)  Has service accredited to the State of  Illinois  or
 4    has  been  a  resident of this State for one year immediately
 5    preceding the date of application; and
 6        (c)  For admission to the Illinois Veterans Homes at Anna
 7    and Quincy, is disabled by disease, wounds, or otherwise  and
 8    because  of  the disability is incapable of earning a living;
 9    or
10        (d)  For admission to  the  Illinois  Veterans  Homes  at
11    LaSalle  and  Manteno  and  for  admission to the John Joseph
12    Kelly Veteran's Home, is  disabled  by  disease,  wounds,  or
13    otherwise  and,  for purposes of eligibility for nursing home
14    care, requires nursing care because of the disability.

16        Section 99.  Effective date.  This Act  takes  effect  on
17    January 1, 2002.".
