 1                     AMENDMENT TO HOUSE BILL 854

 2        AMENDMENT NO.     .  Amend House Bill  854  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.   The Department  of Veterans Affairs Act is
 5    amended by changing Section 2.01 as follows:

 6        (20 ILCS 2805/2.01) (from Ch. 126 1/2, par. 67.01)
 7        Sec. 2.01. Any honorably discharged veteran  is  entitled
 8    to admission to an Illinois Veterans Home, if the applicant:
 9        (a) (1)  Has  served  in  the  armed forces of the United
10    States at least 1 day in the Spanish American War, World  War
11    I,  World War II, the Korean Conflict, the Viet Nam Campaign,
12    or the Persian Gulf Conflict between the dates recognized  by
13    the  U.S. Department of Veterans Affairs or between any other
14    present or future dates recognized by the U.S. Department  of
15    Veterans  Affairs as a war period, or has served in a hostile
16    fire  environment  and  has  been  awarded  a   campaign   or
17    expeditionary  medal  signifying  his  or  her  service,  for
18    purposes of eligibility for domiciliary or nursing home care;
19    or
20        (2)  Has  (i)  served  on active duty in the armed forces
21    for one year for purposes of eligibility for domiciliary care
22    only or (ii) served in the National Guard or  Reserve  Forces

 1    of  the  United States and completed 20 years of satisfactory
 2    service, is otherwise eligible to receive reserve  or  active
 3    duty  retirement  benefits, and has been an Illinois resident
 4    for at least one  year  before  applying  for  admission  for
 5    purposes of eligibility for domiciliary care only; and
 6        (b)  Has  service  accredited to the State of Illinois or
 7    has been a resident of this State for  one  year  immediately
 8    preceding the date of application; and
 9        (c)  For admission to the Illinois Veterans Homes at Anna
10    and  Quincy, is disabled by disease, wounds, or otherwise and
11    because of the disability is incapable of earning  a  living;
12    or
13        (d)  For  admission  to  the  Illinois  Veterans Homes at
14    LaSalle and Manteno and for  admission  to  the  John  Joseph
15    Kelly  Veteran's  Home,  is  disabled  by disease, wounds, or
16    otherwise and, for purposes of eligibility for  nursing  home
17    care, requires nursing care because of the disability.

19        Section  99.  Effective  date.   This Act takes effect on
20    January 1, 2002.".
