92_HB1050ham001 LRB9205608NTsbam 1 AMENDMENT TO HOUSE BILL 1050 2 AMENDMENT NO. . Amend House Bill 1050 by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The School Code is amended by adding 5 Sections 10-28 and 34-18.22 as follows: 6 (105 ILCS 5/10-28 new) 7 Sec. 10-28. Sharing information on school lunch 8 applicants. A school board shall, whenever requested by the 9 Department of Public Aid, agree in writing with the 10 Department of Public Aid (as the State agency that 11 administers the State Medical Assistance Program as provided 12 in Title XIX of the federal Social Security Act and the State 13 Children's Health Insurance Program as provided in Title XXI 14 of the federal Social Security Act) to share with the 15 Department of Public Aid information on applicants for free 16 or reduced-price lunches. A school board shall, whenever 17 requested by the Department of Public Aid, require each of 18 its schools to agree in writing with the Department of Public 19 Aid to share with the Department of Public Aid information on 20 applicants for free or reduced-price lunches. This sharing 21 of information shall be for the sole purpose of helping the 22 Department of Public Aid identify and enroll children in the -2- LRB9205608NTsbam 1 State Medical Assistance Program or the State Children's 2 Health Insurance Program or both as allowed under 42 U.S.C. 3 1758(b)(2)(C)(iii)(IV) and under the restrictions set forth 4 in 42 U.S.C. 1758(b)(2)(C)(vi) and (vii). 5 (105 ILCS 5/34-18.22 new) 6 Sec. 34-18.22. Sharing information on school lunch 7 applicants. The board shall, whenever requested by the 8 Department of Public Aid, agree in writing with the 9 Department of Public Aid (as the State agency that 10 administers the State Medical Assistance Program as provided 11 in Title XIX of the federal Social Security Act and the State 12 Children's Health Insurance Program as provided in Title XXI 13 of the federal Social Security Act) to share with the 14 Department of Public Aid information on applicants for free 15 or reduced-price lunches. The board shall, whenever 16 requested by the Department of Public Aid, require each of 17 its schools to agree in writing with the Department of Public 18 Aid to share with the Department of Public Aid information on 19 applicants for free or reduced-price lunches. The School Breakfast and Lunch Program Act 27 is amended by adding Section 10 as follows: 28 (105 ILCS 125/10 new) 29 Sec. 10. Sharing information on school lunch applicants. 30 Each private school that receives funds for free or 31 reduced-price lunches under this Act shall, whenever -3- LRB9205608NTsbam 1 requested by the Department of Public Aid, agree in writing 2 with the Department of Public Aid (as the State agency that 3 administers the State Medical Assistance Program as provided 4 in Title XIX of the federal Social Security Act and the State 5 Children's Health Insurance Program as provided in Title XXI 6 of the federal Social Security Act) to share with the 7 Department of Public Aid information on applicants for free 8 or reduced-price lunches. This sharing of information shall 9 be for the sole purpose of helping the Department of Public 10 Aid identify and enroll children in the State Medical 11 Assistance Program or the State Children's Health Insurance 12 Program or both as allowed under 42 U.S.C. 13 1758(b)(2)(C)(iii)(IV) and under the restrictions set forth 14 in 42 U.S.C. 1758(b)(2)(C)(vi) and (vii). 15 Section 99. Effective date. This Act takes effect on 16 July 1, 2001.".
