92_HB2046eng HB2046 Engrossed LRB9202183DJtmA 1 AN ACT in relation to health. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Automated External Defibrillator Act is 5 amended by changing Sections 25 and 30 as follows: 6 (410 ILCS 4/25) 7 Sec. 25. Illinois Department of Public Health; 8 responsibilities. The Illinois Department of Public Health 9 shall maintain incident reports on automated external 10 defibrillator use and conduct annual analyses of all related 11 data. The Department shall establish a central data base 12 regarding the location and uses of automated external 13 defibrillators in Illinois, if known from incident reports, 14 specific data collection undertaken by the Department, or 15 other available sources of information. The Department shall 16 adopt rules to carry out its responsibilities under this Act. 17 The Director of Public Health shall establish guidelines 18 with respect to placing automated external defibrillators in 19 State buildings. The guidelines shall take into account the 20 extent to which the devices may be used by lay persons, the 21 typical number of employees and visitors in the buildings, 22 the extent of the need for security measures regarding the 23 buildings, buildings or portions of buildings in which there 24 are special circumstances such as high electrical voltage or 25 extreme heat or cold, and other factors that the Director 26 determines are appropriate. The Director shall recommend the 27 appropriate placement of the automated external 28 defibrillators in State buildings on the basis of the 29 guidelines. The recommendations shall at least include, when 30 appropriate, placement in State buildings in which more than 31 200 persons may be present at any particular time. HB2046 Engrossed -2- LRB9202183DJtmA 1 The Director of Public Health shall establish guidelines 2 with respect to placing automated external defibrillators in 3 all public and private school buildings and other school 4 facilities, including appropriate placements and the training 5 of personnel for use of automated external defibrillators at 6 school-sponsored athletic activities and events. By March 7 1, 2002, the Director shall recommend a program of assistance 8 and training to enable schools' compliance with the 9 guidelines. 10 (Source: P.A. 91-524, eff. 1-1-00.) 11 (410 ILCS 4/30) 12 Sec. 30. Exemption from civil liability. 13 (a) A physician licensed in Illinois to practice 14 medicine in all its branches who authorizes the purchase of 15 an automated external defibrillator is not liable for civil 16 damages as a result of any act or omission arising out of 17 authorizing the purchase of an automated external 18 defibrillator, except for willful or wanton misconduct, if 19 the requirements of this Act are met. 20 (b) An individual or entity providing training in the 21 use of automated external defibrillators is not liable for 22 civil damages as a result of any act or omission involving 23 the use of an automated external defibrillator, except for 24 willful or wanton misconduct, if the requirements of this Act 25 are met. 26 (c) A person owning, occupying, or managing the premises 27 where an automated external defibrillator is located or to 28 which an automated external defibrillator has been moved for 29 use is not liable for civil damages as a result of any act or 30 omission involving the use of an automated external 31 defibrillator, except for willful or wanton misconduct, if 32 the requirements of this Act are met. 33 (d) A trained AED user is not liable for civil damages HB2046 Engrossed -3- LRB9202183DJtmA 1 as a result of any act or omission involving the use of an 2 automated external defibrillator in an emergency situation, 3 except for willful or wanton misconduct, if the requirements 4 of this Act are met. 5 (Source: P.A. 91-524, eff. 1-1-00.) 6 Section 99. Effective date. This Act takes effect upon 7 becoming law.
