1 AN ACT concerning the regulation of professions.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Occupational Therapy Practice
5 Act is amended by changing Section 2 as follows:
6 (225 ILCS 75/2) (from Ch. 111, par. 3702)
7 Sec. 2. In this Act:
8 (1) "Department" means the Department of Professional
9 Regulation.
10 (2) "Director" means the Director of Professional
11 Regulation.
12 (3) "Board" means the Illinois Occupational Therapy
13 Board appointed by the Director.
14 (4) "Registered Occupational Therapist" means a person
15 licensed to practice occupational therapy as defined in this
16 Act, and whose license is in good standing.
17 (5) "Certified Occupational Therapy Assistant" means a
18 person licensed to assist in the practice of occupational
19 therapy under the supervision of a Registered Occupational
20 Therapist, and to implement the occupational therapy
21 treatment program as established by the Registered
22 Occupational Therapist. Such program may include training in
23 activities of daily living, the use of therapeutic activity
24 including task oriented activity to enhance functional
25 performance, and guidance in the selection and use of
26 adaptive equipment.
27 (6) "Occupational Therapy" means the evaluation of
28 functional performance ability of persons impaired by
29 physical illness or injury, emotional disorder, congenital or
30 developmental disability, or the aging process, and the
31 analysis, selection and application of occupations or goal

1 directed activities, for the treatment or prevention of these
2 disabilities to achieve optimum functioning. Occupational
3 therapy services include, but are not limited to activities
4 of daily living (ADL); the design fabrication and application
5 or splints, administration and interpretation of standardized
6 tests to identify dysfunctions, sensory-integrative and
7 perceptual motor activities, the use of task oriented
8 activities, guidance in the selection and use of assistive
9 devices, goal oriented activities directed toward enhancing
10 functional performance, prevocational evaluation and
11 vocational training, and consultation in the adaptation of
12 physical environments for the handicapped. These services
13 are provided to individuals or groups through medical,
14 health, educational, and social systems. An occupational
15 therapist may evaluate a person but shall obtain a referral
16 by a physician or optometrist before treatment is
17 administered by the occupational therapist. An occupational
18 therapist shall refer to a licensed physician, dentist,
19 optometrist, or podiatrist any patient whose medical
20 condition should, at the time of evaluation or treatment, be
21 determined to be beyond the scope of practice of the
22 occupational therapist.
