92_HB3938enr HB3938 Enrolled LRB9212962NTdv 1 AN ACT concerning schools. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The School Code is amended by changing 5 Sections 10-20.28 and 34-18.14 as follows: 6 (105 ILCS 5/10-20.28) (from Ch. 122, par. 10-20.28) 7 Sec. 10-20.28. Cellular radio telecommunication devices 8prohibition. 9 (a) The General Assembly finds and declares that the 10 educational development of all persons to the limits of their 11 capacities is a fundamental goal of the people of this State 12 and that to achieve such goal it is essential to provide a 13 safe and secure learning environment within the public 14 schools. While recognizing that cellular radio 15 telecommunication devices may be used for inappropriate 16 activities during school hours and on school property and 17 may, on occasion, cause disruption to the classroom 18 environment, the General Assembly also recognizes that the 19 use of cellular radio telecommunication devices can decrease 20 the response time of officials to emergency situations. In 21 addition, cellular radio telecommunication devices allow 22 parents an additional and timely method of contacting their 23 children should an emergency situation arise. Therefore, it 24 is the purpose and intention of the General Assembly in 25 enacting this legislation to (i) reduce the occurrence of 26 inappropriate and disruptive activities during school hours 27 and on school property occurring through the use of cellular 28 radio telecommunication devices and (ii) increase the safety 29 of students and school personnel during school hours and on 30 school property. 31 (b) The school board may establish appropriate rules and HB3938 Enrolled -2- LRB9212962NTdv 1 disciplinary procedures governing the use or possession of 2 cellular radio telecommunication devices by a student while 3 in a school or on school property, during regular school 4 hours, or at any other time.To prohibit the use or5possession of any cellular radio telecommunication device by6any pupil while such pupil is in any school building or on7any school property, during regular school hours or at any8other time, and to by rule provide for the imposition of9appropriate discipline upon any pupil who violates such10prohibition.
