 1                    AMENDMENT TO HOUSE BILL 3938

 2        AMENDMENT NO.     .  Amend House Bill 3938  by  replacing
 3    everything after the enacting clause with the following:

 4        "Section  5.   The  School  Code  is  amended by changing
 5    Sections 10-20.28 and 34-18.14 as follows:

 6        (105 ILCS 5/10-20.28) (from Ch. 122, par. 10-20.28)
 7        Sec. 10-20.28.  Cellular radio telecommunication  devices
 8    prohibition.
 9        (a)  The  General  Assembly  finds  and declares that the
10    educational development of all persons to the limits of their
11    capacities is a fundamental goal of the people of this  State
12    and  that  to  achieve such goal it is essential to provide a
13    safe  and  secure  learning  environment  within  the  public
14    schools.    While    recognizing    that    cellular    radio
15    telecommunication  devices  may  be  used  for  inappropriate
16    activities during school hours and  on  school  property  and
17    may,   on   occasion,   cause  disruption  to  the  classroom
18    environment, the General Assembly also  recognizes  that  the
19    use  of cellular radio telecommunication devices can decrease
20    the response time of officials to  emergency  situations.  In
21    addition,  cellular  radio  telecommunication  devices  allow
22    parents  an  additional and timely method of contacting their

 1    children should an emergency situation arise.  Therefore,  it
 2    is  the  purpose  and  intention  of  the General Assembly in
 3    enacting this legislation to (i)  reduce  the  occurrence  of
 4    inappropriate  and  disruptive activities during school hours
 5    and on school property occurring through the use of  cellular
 6    radio  telecommunication devices and (ii) increase the safety
 7    of students and school personnel during school hours  and  on
 8    school property.
 9        (b)  The school board may establish appropriate rules and
10    disciplinary  procedures  governing  the use or possession of
11    cellular radio telecommunication devices by a  student  while
12    in  a  school  or  on  school property, during regular school
13    hours,  or  at  any  other  time.  To  prohibit  the  use  or
14    possession of any cellular radio telecommunication device  by
15    any  pupil  while  such pupil is in any school building or on
16    any school property, during regular school hours  or  at  any
17    other  time,  and  to  by  rule provide for the imposition of
18    appropriate discipline  upon  any  pupil  who  violates  such
19    prohibition.  Exceptions may be made by the school board with
20    the approval of the school principal.

27        Section  99.  Effective date.  This Act takes effect upon
28    becoming law.".
