 1                    AMENDMENT TO HOUSE BILL 4890

 2        AMENDMENT NO. ___. Amend House Bill 4890 as follows:
 3    on page 1, line 5, after "6,", by inserting "8,"; and

 4    on page 1, line 20,  after  "sale",  by  inserting  "off  the
 5    premises  where  the  flock  is  located, such as at farmers'
 6    markets, and"; and

 7    on page 2, by replacing lines 5 and 6 with the following:
 8    "sale for consumer use after  the  original  30-day  candling
 9    date. All eggs candled or candled and"; and

10    on  page  2, by replacing lines 15 and 16 with the following:
11    "from after the candling packing date for grade  A  eggs  and
12    not  later  than  15 days from the candling date for grade AA
13    eggs."; and

14    on page 3, below line 2, by inserting the following:

15        "(410 ILCS 615/8) (from Ch. 56 1/2, par. 55-8)
16        Sec. 8.  Any person or business who buys, sells,  trades,
17    or   traffics  in  eggs  in  this  State  and  is  a  broker,
18    distributor, handler, packer, producer,  or  producer-dealer,
19    as  defined  in  this  Act, must be licensed in this State. A
20    limited or full license must be purchased annually. No person
21    or business shall buy, sell, trade, or traffic in barter eggs

 1    in this State without having obtained a license  as  provided
 2    in Section 9, except the following:
 3        (a)  A  producer  who  obtains  eggs  from his own flock,
 4    regardless of the size of the flock, and sells them  as  nest
 5    run eggs, either to household consumers on the premises where
 6    the  flock  is  located,  or  to a holder of an  Illinois Egg
 7    License;
 8        (b)  Hatcheries  which   purchase   eggs   to   be   used
 9    exclusively for hatching purposes;
10        (c)  Institutional consumers where all eggs purchased are
11    served in the establishment;
12        (d)  Manufacturers  of  food  products  who  use all eggs
13    purchased   in   their    products    such    as    bakeries,
14    confectioneries, and ice cream manufacturers, etc.;
15        (e)  Agents  employed  and  carried  on  the payroll on a
16    salary  basis by licensed dealers or distributors;
17        (f)  A consumer buying eggs for his own consumption;
18        (g)  A retailer who buys eggs from licensed  distributors
19    or from licensed handlers only and sells eggs only at retail.

21    on  page  3,  lines 11 and 12, by replacing "packs and sells"
22    with "packed and sold".
