The Illinois Vehicle Code is amended by 5 changing Sections 13A-115 and 13B-25 as follows: 6 (625 ILCS 5/13A-115) (from Ch. 95 1/2, par. 13A-115) 7 Sec. 13A-115. Effectiveness. This Chapter 13A is 8 repealed on January 1, 2003shall cease to be effective when9the continuation of the program has been implemented under10Chapter 13B. 11 (Source: P.A. 86-1433; 88-533.) 12 (625 ILCS 5/13B-25) 13 Sec. 13B-25. Performance of inspections. 14 (a) The inspection of vehicles required under this 15 Chapter shall be performed only: (i) by inspectors who have 16 been certified by the Agency after successfully completing a 17 course of training and successfully passing a written test; 18 (ii) at official inspection stations or official on-road 19 inspection sites established under this Chapter; and (iii) 20 with equipment that has been approved by the Agency for these 21 inspections. -2- LRB9211482EGfgam01 1 (b) Except as provided in subsections (c) and (d), the 2 inspection shall consist of (i) a loaded mode exhaust gas 3 analysis; (ii) an evaporative system integrity test; (iii) an 4 on-board computer diagnostic system check; and (iv) a 5 verification that all required emission-related recall 6 repairs have been made under Title 40, Section 51.370 of the 7 Code of Federal Regulations;,and may also include an 8 evaporative system purge test. The owner of the vehicle or 9 the owner's agent shall be entitled to an emission inspection 10 certificate issued by an inspector only if all required tests 11 are passed at the time of the inspection. 12 (c) A steady-state idle exhaust gas analysis may be 13 substituted for the loaded mode exhaust gas analysis and the 14 evaporative purge system test in the following cases: 15 (1) On any vehicle of model year 1980 or older. 16 (2) On any heavy duty vehicle with a manufacturer 17 gross vehicle weight rating in excess of 8,500 pounds. 18 (3) On any vehicle for which loaded mode testing is 19 not possible due to vehicle design or configuration. 20 (d) The procedures contained in subsections (d)(1) and 21 (d)(2) of this Section shall be followed on model year 1996 22 and newer vehicles equipped with OBD on-board computer 23 diagnostic equipment, as required. 24 (1) Beginning on July 1, 2002, and continuing 25 through December 31, 2003, such vehicles shall be given a 26 complete on-board diagnostic test consistent with the 27 requirements of paragraphs (d)(1)(A) through (d)(1)(D) of 28 this Section. 29 (A) If the vehicle meets the standards set for 30 the complete on-board computer diagnostic test, 31 neither the loaded mode exhaust gas analysis nor the 32 idle exhaust gas analysis shall be performed; 33 however, all other elements of the test contained in 34 subsection (b) of this Section shall be performed. -3- LRB9211482EGfgam01 1 (B) If, however, the vehicle fails to meet the 2 standard for the complete on-board computer 3 diagnostic test, it shall be given the loaded mode 4 exhaust gas analysis or the idle exhaust gas 5 analysis, as required, and all other elements of the 6 test contained in subsection (b) of this Section, 7 unless the owner of the vehicle chooses to avoid the 8 loaded mode exhaust gas analysis or idle exhaust gas 9 analysis and proceed directly under paragraph 10 (d)(1)(C) of this Section. 11 (C) If the vehicle fails to meet the standard 12 for the complete on-board computer diagnostic test 13 and the standard for the loaded mode exhaust gas 14 analysis or the idle exhaust gas analysis, as 15 required, or the owner of the vehicle has chosen to 16 avoid the loaded mode exhaust gas analysis or idle 17 exhaust gas analysis and proceed directly under this 18 paragraph, the vehicle must be repaired to pass 19 either the complete on-board computer diagnostic 20 test or the loaded mode exhaust gas analysis or idle 21 exhaust gas analysis, as required, and all other 22 elements of the test contained in subsection (b) of 23 this Section. 24 (D) The on-board computer diagnostic test 25 shall not be a required element of the inspection 26 mandated by this Section for such vehicles for which 27 on-board computer diagnostic testing is not possible 28 due to the vehicle's originally certified design or 29 its design as modified in accordance with federal 30 law and regulations. In such cases, all other 31 elements of the inspection required under this 32 Section shall be performed on such vehicles, 33 including the exhaust gas analysis as specified in 34 subsection (b) of this Section. -4- LRB9211482EGfgam01 1 (2) Beginning on January 1, 2004, such vehicles 2 shall be given a complete on-board diagnostic test 3 consistent with the requirements of paragraphs (d)(2)(A) 4 and (d)(2)(B) of this Section. 5 (A) The loaded mode exhaust gas analysis 6 specified in subsection (b) of this Section shall 7 not be performed on such vehicles for which the 8 on-board computer diagnostic test specified in 9 subsection (h) of this Section can be performed. 10 All other elements of the inspection required for 11 such vehicles shall be performed in accordance with 12 the provisions of this Section. 13 (B) The on-board computer diagnostic test 14 shall not be a required element of the inspection 15 mandated by this Section for such vehicles for which 16 on-board computer diagnostic testing is not possible 17 due to the vehicle's originally certified design or 18 its design as modified in accordance with federal 19 law and regulations. In such cases, all other 20 elements of the inspection required under this 21 Section shall be performed on such vehicles, 22 including the exhaust gas analysis as specified in 23 subsection (b) of this Section. 24A steady-state idle gas analysis may also be substituted for25the new procedures specified in subsection (b) in inspections26conducted in calendar year 1995 on any vehicle of model year271990 or older.28 (e) The exhaust gas analysis shall consist of a test of 29 an exhaust gas sample to determine whether the quantities of 30 exhaust gas pollutants emitted by the vehicle meet the 31 standards set for vehicles of that type under Section 13B-20. 32 A vehicle shall be deemed to have passed this portion of the 33 inspection if the evaluation of the exhaust gas sample 34 indicates that the quantities of exhaust gas pollutants -5- LRB9211482EGfgam01 1 emitted by the vehicle do not exceed the standards set for 2 vehicles of that type under Section 13B-20 or an inspector 3 certifies that the vehicle qualifies for a waiver of the 4 exhaust gas pollutant standards under Section 13B-30. 5 (f) The evaporative system integrity test shall consist 6 of a procedure to determine if leaks exist in all or a 7 portion of the vehicle fuel evaporation emission control 8 system. A vehicle shall be deemed to have passed this test 9 if it meets the criteria that the Board may adopt for an 10 evaporative system integrity test. 11 (g) The evaporative system purge test shall consist of a 12 procedure to verify the purging of vapors stored in the 13 evaporative canister. A vehicle shall be deemed to have 14 passed this test if it meets the criteria that the Board may 15 adopt for an evaporative system purge test. 16 (h) The on-board computer diagnostic test shall consist 17 of accessing the vehicle's on-board computer system, if so 18 equipped, and reading any stored diagnostic codes that may be 19 present. The vehicle shall be deemed to have passed this 20 test if the codes observed did not exceed standards set for 21 vehicles of that type under Section 13B-20. 22 (Source: P.A. 90-475, eff. 8-17-97.) 23 Section 99.
