92_HB5633 LRB9211330EGfg 1 AN ACT in relation to public employee benefits. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Pension Code is amended by 5 changing Section 4-106.1 as follows: 6 (40 ILCS 5/4-106.1) (from Ch. 108 1/2, par. 4-106.1) 7 Sec. 4-106.1. Discontinuation of fire protection 8 district; annexation to fire protection district. 9 (a) Whenever a fire protection district which has 10 established a pension fund under this Article is discontinued 11 under "An Act in Relation to Fire Protection Districts", and 12 the municipality assuming the obligations of the district is 13 required to and has established a Firefighters' Pension Fund 14 under this Article, the assets of the fund established by the 15 district shall be transferred to the "Board of Trustees of 16 the Firefighters Pension Fund" of the municipality. The 17 Firefighter's Pension Fund of the municipality shall assume 18 all accrued liabilities of the district's pension fund, and 19 all accrued rights, benefits and future expectancies of the 20 members, retired employees and beneficiaries of the 21 district's fund shall remain unimpaired. 22 (b) If a municipal fire department for which a pension 23 fund has been established under this Article is discontinued 24 and the affected territory is annexed by a fire protection 25 district, and the fire protection district is required to and 26 has established a firefighters' pension fund under this 27 Article, then the assets of the firefighters' pension fund 28 established by the municipality shall be transferred to the 29 board of trustees of the pension fund of the fire protection 30 district. The firefighters' pension fund of the fire 31 protection district shall assume all liabilities of the -2- LRB9211330EGfg 1 municipality's firefighters' pension fund, and all of the 2 accrued rights, benefits, and future expectancies of the 3 members, retired employees, and beneficiaries of the 4 municipality's firefighters' pension fund shall remain 5 unimpaired. 6 (Source: P.A. 83-1440.) 7 Section 90. The State Mandates Act is amended by adding 8 Section 8.26 as follows: 9 (30 ILCS 805/8.26 new) 10 Sec. 8.26. Exempt mandate. Notwithstanding Sections 6 11 and 8 of this Act, no reimbursement by the State is required 12 for the implementation of any mandate created by this 13 amendatory Act of the 92nd General Assembly. 14 Section 99. Effective date. This Act takes effect upon 15 becoming law.
