92_HB5807 LRB9213004AGcs 1 AN ACT concerning organ donation. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Organ Donor Leave Act. 6 Section 5. Purpose. This Act is intended to provide 7 time off with pay for State employees who donate an organ or 8 bone marrow. 9 Section 10. Definitions. As used in this Act: 10 "Agency" means any branch, department, board, committee, 11 or commission of State government, but does not include units 12 of local government, school districts, or boards of election 13 commissioners. 14 "Department" means the Department of Central Management 15 Services. 16 "Participating employee" means a permanent full-time or 17 part-time employee who has been employed by an agency for a 18 period of 6 months or more and who donates an organ or bone 19 marrow. 20 Section 20. Administration of Act. 21 (a) On request, a participating employee subject to this 22 Act may be entitled to organ donation leave with pay. 23 (b) An employee may use (i) up to 7 days of organ 24 donation leave in any 12-month period to serve as a bone 25 marrow donor and (ii) up to 30 days of organ donation leave 26 in any 12-month period to serve as an organ donor. 27 (c) An employee may use organ donation leave only after 28 obtaining approval from the employee's agency. 29 (d) An employee may not be required to use accumulated -2- LRB9213004AGcs 1 sick or vacation leave time before being eligible for organ 2 donor leave. 3 (e) The Department must adopt rules governing organ 4 donation leave, including rules that (i) establish conditions 5 and procedures for requesting and approving leave and (ii) 6 require medical documentation of the proposed organ or bone 7 marrow donation before leave is approved by the employing 8 agency. 9 Section 99. Effective date. This Act takes effect on 10 January 1, 2003.
