92_HB5807eng HB5807 Engrossed LRB9213004AGcs 1 AN ACT concerning organ donation. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Organ Donor Leave Act. 6 Section 5. Purpose. This Act is intended to provide 7 time off with pay for State employees who donate an organ, 8 bone marrow, blood, or blood platelets. 9 Section 10. Definitions. As used in this Act: 10 "Agency" means any branch, department, board, committee, 11 or commission of State government, but does not include units 12 of local government, school districts, or boards of election 13 commissioners. 14 "Department" means the Department of Central Management 15 Services. 16 "Participating employee" means a permanent full-time or 17 part-time employee who has been employed by an agency for a 18 period of 6 months or more and who donates an organ, bone 19 marrow, blood, or blood platelets. 20 Section 20. Administration of Act. 21 (a) On request, a participating employee subject to this 22 Act may be entitled to organ donation leave with pay. 23 (b) An employee may use (i) up to 30 days of organ 24 donation leave in any 12-month period to serve as a bone 25 marrow donor, (ii) up to 30 days of organ donation leave in 26 any 12-month period to serve as an organ donor, (iii) up to 27 one hour to donate blood every 56 days, and (iv) up to 2 28 hours to donate blood platelets in accordance with 29 appropriate medical standards established by the American Red HB5807 Engrossed -2- LRB9213004AGcs 1 Cross or other nationally-recognized standards. Leave under 2 item (iv) may not be granted more than 24 times in a 12-month 3 period. 4 (c) An employee may use organ donation leave or other 5 leave authorized in subsection (b) of this Section only after 6 obtaining approval from the employee's agency. 7 (d) An employee may not be required to use accumulated 8 sick or vacation leave time before being eligible for organ 9 donor leave. 10 (e) The Department must adopt rules governing organ 11 donation leave, including rules that (i) establish conditions 12 and procedures for requesting and approving leave and (ii) 13 require medical documentation of the proposed organ or bone 14 marrow donation before leave is approved by the employing 15 agency. 16 Section 99. Effective date. This Act takes effect on 17 January 1, 2003.
