92_SB0028 LRB9201184ARsb 1 An Act concerning criminal law. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Criminal Code of 1961 is amended by 5 adding Section 12-21.7 as follows: 6 (720 ILCS 5/12-21.7 new) 7 Sec. 12-21.7. Leaving a child unattended in a vehicle. 8 (a) A person commits the offense of leaving a child 9 unattended in a vehicle when he or she knowingly leaves a 10 child under 11 years of age unattended in a motor vehicle. 11 (b) For purposes of this Section: 12 (1) "Injury" means physical harm to the body of a 13 person; 14 (2) "Motor vehicle" means every device, in, upon, 15 or by which not more than 10 persons may be transported 16 or drawn upon a highway, except devices moved by human 17 power, devices used exclusively upon stationary rails or 18 tracks and snowmobiles as defined in the Snowmobile 19 Registration and Safety Act. 20 (3) "Unattended" means not accompanied by a person 21 14 years of age or older. 22 (c) Sentence. A violation of this Section is a Class C 23 misdemeanor. A violation of this Section that is the 24 proximate cause of injury to the child or to any other person 25 is a Class A misdemeanor. A violation of this Section that 26 is the proximate cause of death of the child or any other 27 person is a Class 4 felony. 28 Section 99. Effective date. This Act takes effect upon 29 becoming law.
