92_SB0527enr SB527 Enrolled LRB9204908LBgc 1 AN ACT concerning the regulation of professions. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Occupational Therapy Practice 5 Act is amended by changing Section 2 and by adding Section 6 3.2 as follows: 7 (225 ILCS 75/2) (from Ch. 111, par. 3702) 8 Sec. 2. In this Act: 9 (1) "Department" means the Department of Professional 10 Regulation. 11 (2) "Director" means the Director of Professional 12 Regulation. 13 (3) "Board" means the Illinois Occupational Therapy 14 Board appointed by the Director. 15 (4) "Registered Occupational Therapist" means a person 16 licensed to practice occupational therapy as defined in this 17 Act, and whose license is in good standing. 18 (5) "Certified Occupational Therapy Assistant" means a 19 person licensed to assist in the practice of occupational 20 therapy under the supervision of a Registered Occupational 21 Therapist, and to implement the occupational therapy 22 treatment program as established by the Registered 23 Occupational Therapist. Such program may include training in 24 activities of daily living, the use of therapeutic activity 25 including task oriented activity to enhance functional 26 performance, and guidance in the selection and use of 27 adaptive equipment. 28 (6) "Occupational Therapy" means the evaluation of 29 functional performance ability of persons impaired by 30 physical illness or injury, emotional disorder, congenital or 31 developmental disability, or the aging process, and the SB527 Enrolled -2- LRB9204908LBgc 1 analysis, selection and application of occupations or goal 2 directed activities, for the treatment or prevention of these 3 disabilities to achieve optimum functioning. Occupational 4 therapy services include, but are not limited to activities 5 of daily living (ADL); the design fabrication and application 6 or splints, administration and interpretation of standardized 7 tests to identify dysfunctions, sensory-integrative and 8 perceptual motor activities, the use of task oriented 9 activities, guidance in the selection and use of assistive 10 devices, goal oriented activities directed toward enhancing 11 functional performance, prevocational evaluation and 12 vocational training, and consultation in the adaptation of 13 physical environments for the handicapped. These services 14 are provided to individuals or groups through medical, 15 health, educational, and social systems. An occupational 16 therapist may evaluate a person but shall obtain a referral 17 by a physician or optometrist before treatment is 18 administered by the occupational therapist. An occupational 19 therapist shall refer to a licensed physician, dentist, 20 optometrist, or podiatrist any patient whose medical 21 condition should, at the time of evaluation or treatment, be 22 determined to be beyond the scope of practice of the 23 occupational therapist. 24 (Source: P.A. 88-424.) 25 (225 ILCS 75/3.2 new) 26 Sec. 3.2. Practice of optometry. An occupational 27 therapist may not perform an act, task, or function primarily 28 performed in the lawful practice of optometry under the 29 Illinois Optometric Practice Act of 1987.
