92_SB0633eng SB633 Engrossed LRB9204517LBmb 1 AN ACT concerning the regulation of professions. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Acupuncture Practice Act is amended by 5 adding Section 20.1 and changing Section 50 as follows: 6 (225 ILCS 2/20.1 new) 7 Sec. 20.1. Guest instructors of acupuncture. The 8 provisions of this Act do not prohibit an acupuncturist from 9 another State or country, who is not licensed under this Act 10 and who is an invited guest of a professional acupuncture 11 association or scientific acupuncture foundation or an 12 acupuncture training program or continuing education provider 13 that is approved under this Act, from engaging in 14 professional education through lectures, clinics, or 15 demonstrations. To qualify as a guest instructor of 16 acupuncture, the acupuncturist must have been issued a guest 17 instructor of acupuncture permit by the Department. The 18 Department shall grant a guest instructor of acupuncture 19 permit if the Department determines that the applicant for 20 the permit (i) is currently certified in good standing as an 21 acupuncturist by the National Certification Commission for 22 Acupuncture and Oriental Medicine; or (ii) has sufficient 23 training to qualify as a licensed acupuncturist in Illinois. 24 By rule, the Department may prescribe forms that shall be 25 used to apply for guest instructor of acupuncture permits and 26 charge an application fee to defray expenses borne by the 27 Department in connection with implementation of this 28 amendatory Act of the 92nd General Assembly. The applicant 29 shall submit his or her application for a guest instructor of 30 acupuncture permit to the Department. The Department shall 31 issue a guest instructor of acupuncture permit, or indicate SB633 Engrossed -2- LRB9204517LBmb 1 why the Department has refused to issue the permit, within 60 2 days after the application is complete and on file with the 3 Department. The Department shall maintain a registry of 4 guest instructors of acupuncture. A guest instructor of 5 acupuncture permit shall be valid for 12 months. The guest 6 instructor of acupuncture may engage in the application of 7 acupuncture techniques in conjunction with the lectures, 8 clinics, or demonstrations for a maximum of 12 months, but 9 may not open an office, appoint a place to meet private 10 patients, consult with private patients, or otherwise engage 11 in the practice of acupuncture beyond what is required in 12 conjunction with these lectures, clinics, or demonstrations. 13 (225 ILCS 2/50) 14 Sec. 50. Practice prohibited. Unless he or she has been 15 issued, by the Department, a valid, existing license as an 16 acupuncturist under this Act, no person may use the title and 17 designation of "Acupuncturist", "Licensed Acupuncturist", 18 "Certified Acupuncturist", "C.A.", "Act.", "Lic. Act.", or 19 "Lic. Ac." either directly or indirectly, in connection with 20 his or her profession or business. No person licensed under 21 this Act may use the designation "medical", directly or 22 indirectly, in connection with his or her profession or 23 business. Nothing shall prevent a physician from using the 24 designation "Acupuncturist". 25 No person may practice, offer to practice, attempt to 26 practice, or hold himself or herself out to practice as a 27 licensed acupuncturist without being licensed under this Act. 28 This Act does not prohibit a person from applying 29 acupuncture techniques as part of his or her educational 30 training when he or she: 31 (1) is engaged in a State-approved course in 32 acupuncture, as provided in this Act; 33 (2) is a graduate of a school of acupuncture and SB633 Engrossed -3- LRB9204517LBmb 1 participating in a postgraduate training program; 2 (3) is a graduate of a school of acupuncture and 3 participating in a review course in preparation for 4 taking the National Certification Commission for 5 Acupuncture and Oriental Medicine examination; or 6 (4) is participating in a State-approved continuing 7 education course offered through a State-approved 8 provider. 9 Students attending schools of acupuncture, and 10 professional acupuncturists who are not licensed in Illinois, 11 may engage in the application of acupuncture techniques in 12 conjunction with their education as provided in this Act, but 13 may not open an office, appoint a place to meet private 14 patients, consult with private patients, or otherwise engage 15 in the practice of acupuncture beyond what is required in 16 conjunction with their education. 17 (Source: P.A. 89-706, eff. 1-31-97; 90-61, eff. 7-3-97.) 18 Section 99. Effective date. This Act takes effect upon 19 becoming law.
