92_SB0699 LRB9207709DHmb 1 AN ACT concerning highways. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Highway Code is amended by 5 adding Section 4-411 as follows: 6 (605 ILCS 5/4-411 new) 7 Sec. 4-411. Failure to remove property from a State 8 highway. The failure of any person or entity to remove from a 9 State highway any property that had been placed there by the 10 person or entity in connection with a road improvement 11 project, within a reasonable time after the person or entity 12 has ceased to work on the project, is a business offense 13 punishable by a fine of not more than $2,500. The offense is 14 committed when (i) the entity has received written notice 15 from the Department that an offense punishable by a fine of 16 up to $2,500 per day would be committed if the property was 17 not removed in 15 days and (ii) the property has not been 18 removed as of 15 days after the date the written notice was 19 received. A separate offense, punishable by a separate fine, 20 is committed each day the property remains on the highway 21 after the 15-day notice period has elapsed.
