92_SB0935enr SB935 Enrolled LRB9207852JSpc 1 AN ACT concerning insurance. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 3. The State Employees Group Insurance Act of 5 1971 is amended by changing Section 6.11 as follows: 6 (5 ILCS 375/6.11) 7 Sec. 6.11. Required health benefits; Illinois Insurance 8 Code requirements. The program of health benefits shall 9 provide the post-mastectomy care benefits required to be 10 covered by a policy of accident and health insurance under 11 Section 356t of the Illinois Insurance Code. The program of 12 health benefits shall provide the coverage required under 13 Sections 356u, 356w, and 356x of the Illinois Insurance Code. 14 The program of health benefits must comply with Section 15 155.37 of the Illinois Insurance Code. 16 (Source: P.A. 90-7, eff. 6-10-97; 90-655, eff. 7-30-98; 17 90-741, eff. 1-1-99.) 18 Section 5. The Illinois Insurance Code is amended by 19 adding Sections 155.37, 370t, and 511.114 as follows: 20 (215 ILCS 5/155.37 new) 21 Sec. 155.37. Drug formulary; notice. Insurance 22 companies that transact the kinds of insurance authorized 23 under Class 1(b) or Class 2(a) of Section 4 of this Code and 24 provide coverage for prescription drugs through the use of a 25 drug formulary must notify insureds of any change in the 26 formulary. A company may comply with this Section by posting 27 changes in the formulary on its website. 28 (215 ILCS 5/370t new) SB935 Enrolled -2- LRB9207852JSpc 1 Sec. 370t. Drug formulary; notice. All administrators 2 must comply with Section 155.37 of this Code. 3 (215 ILCS 5/511.114 new) 4 Sec. 511.114. Drug formulary; notice. All 5 administrators must comply with Section 155.37 of this Code. 6 Section 10. The Comprehensive Health Insurance Plan Act 7 is amended by adding Section 8.7 as follows: 8 (215 ILCS 105/8.7 new) 9 Sec. 8.7. Drug formulary; notice. The plan must comply 10 with Section 155.37 of the Illinois Insurance Code. 11 Section 15. The Health Maintenance Organization Act is 12 amended by changing Section 4-6.5 as follows: 13 (215 ILCS 125/4-6.5) 14 Sec. 4-6.5. Required health benefits; Illinois Insurance 15 Code requirements. A health maintenance organization is 16 subject to the provisions of Sections 155.37, 356t, and 356u 17 of the Illinois Insurance Code. 18 (Source: P.A. 90-7, eff. 6-10-97.) 19 Section 20. The Limited Health Service Organization Act 20 is amended by changing Section 4003 as follows: 21 (215 ILCS 130/4003) (from Ch. 73, par. 1504-3) 22 Sec. 4003. Illinois Insurance Code provisions. Limited 23 health service organizations shall be subject to the 24 provisions of Sections 133, 134, 137, 140, 141.1, 141.2, 25 141.3, 143, 143c, 147, 148, 149, 151, 152, 153, 154, 154.5, 26 154.6, 154.7, 154.8, 155.04, 155.37, 355.2, 356v, 368a, 401, 27 401.1, 402, 403, 403A, 408, 408.2, 409, 412, 444, and 444.1 SB935 Enrolled -3- LRB9207852JSpc 1 and Articles IIA, VIII 1/2, XII, XII 1/2, XIII, XIII 1/2, 2 XXV, and XXVI of the Illinois Insurance Code. For purposes 3 of the Illinois Insurance Code, except for Sections 444 and 4 444.1 and Articles XIII and XIII 1/2, limited health service 5 organizations in the following categories are deemed to be 6 domestic companies: 7 (1) a corporation under the laws of this State; or 8 (2) a corporation organized under the laws of 9 another state, 30% of more of the enrollees of which are 10 residents of this State, except a corporation subject to 11 substantially the same requirements in its state of 12 organization as is a domestic company under Article VIII 13 1/2 of the Illinois Insurance Code. 14 (Source: P.A. 90-25, eff. 1-1-98; 90-583, eff. 5-29-98; 15 90-655, eff. 7-30-98; 91-549, eff. 8-14-99; 91-605, eff. 16 12-14-99; 91-788, eff. 6-9-00.) 17 Section 25. The Voluntary Health Services Plans Act is 18 amended by changing Section 10 as follows: 19 (215 ILCS 165/10) (from Ch. 32, par. 604) 20 Sec. 10.
