92_SB1180sam001 LRB9204221LBmgam02 1 AMENDMENT TO SENATE BILL 1180 2 AMENDMENT NO. . Amend Senate Bill 1180 by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The Environmental Protection Act is amended 5 by changing and renumbering Section 58.15 (as added by Public 6 Act 91-442) as follows: 7 (415 ILCS 5/58.16) 8 Sec. 58.16.58.15.Construction of school; requirements. 9 This Section applies only to counties with a population of 10 more than 3,000,000. In this Section, "school" means a 11 school as defined in Section 34-1.1 of the School Code. No 12 person shall commence construction on real property of a 13 building intended for use as a school unless: 14 (1) a Phase 1 Environmental Audit, conducted 15 in accordance with Section 22.2 of this Act, is 16 obtained; 17 (2) if the Phase 1 Environmental Audit 18 discloses the presence or likely presence of a 19 release or a substantial threat of a release of a 20 regulated substance at, on, to, or from the real 21 property, a Phase II Environmental Audit, conducted 22 in accordance with Section 22.2 of this Act, is -2- LRB9204221LBmgam02 1 obtained; and 2 (3) if the Phase II Environmental Audit 3 discloses the presence or likely presence of a 4 release or a substantial threat of a release of a 5 regulated substance at, on, to, or from the real 6 property, and (i) the real property is enrolled in 7 the Site Remediation Program, and (ii) the remedial 8 action plan is approved bythatthe Agency, if a 9 remedial action plan is requiredapproves for the10intended use of the property is completed. 11 No person shall cause or allow any person to occupy a 12 building intended to be used as a school for which a remedial 13 action plan is required by Board regulations unless all work 14 pursuant to the remedial action is completed. 15 (Source: P.A. 91-442, eff. 1-1-00; revised 10-19-99.) 16 Section 99. Effective date. This Act takes effect upon 17 becoming law.".
