 1                    AMENDMENT TO SENATE BILL 1576

 2        AMENDMENT NO.     .  Amend Senate Bill 1576, AS  AMENDED,
 3    by  replacing  everything  after the enacting clause with the
 4    following:

 5        "Section  5.  The Criminal Code of  1961  is  amended  by
 6    changing Section 24-3.4 as follows:

 7        (720 ILCS 5/24-3.4) (from Ch. 38, par. 24-3.4)
 8        Sec.   24-3.4.   Unlawful  sale  of  firearms  by  liquor
 9    licensee.
10        (a)  It shall be unlawful for  any  person  or  agent  or
11    employee of that person who holds a license to sell at retail
12    any  alcoholic  liquor  issued by the Illinois Liquor Control
13    Commission or local liquor  control  commissioner  under  the
14    Liquor  Control  Act  of  1934 or an agent or employee of the
15    licensee to sell or deliver to any other person a firearm  in
16    or  on  the  real  property  of  the  establishment where the
17    licensee is licensed to sell  alcoholic  liquors  unless  the
18    licensed  seller allows only off premise sales (as defined in
19    subdivision (d)(2) of Section 5-1 of the Liquor  Control  Act
20    of  1934),  such alcoholic liquor sales account for less than
21    15% of the sales of all tangible personal  property,  firearm
22    sales  account for less than 15% of the sales of all tangible

 1    personal property, and the sale or delivery of the firearm is
 2    otherwise lawful under this Article  and  under  the  Firearm
 3    Owners Identification Card Act.
 4        (b)  Sentence.   A  violation  of  subsection (a) of this
 5    Section is a Class 4 felony.

 7        Section 99.  Effective date.  This Act takes effect  upon
 8    becoming law.".
