 1                    AMENDMENT TO SENATE BILL 1635

 2        AMENDMENT NO.     .  Amend Senate Bill 1635, on  page  1,
 3    line  5,  by  replacing  "Section  3.1-20-10"  with "Sections
 4    3.1-20-10 and 3.1-20-20"; and

 5    on page 2,  immediately  below  line  11,  by  inserting  the
 6    following:

 7        "(65 ILCS 5/3.1-20-20) (from Ch. 24, par. 3.1-20-20)
 8        Sec. 3.1-20-20.  Aldermen; restrict or reinstate number.
 9        (a)  In  a  city  of  less  than  100,000  inhabitants, a
10    proposition to restrict the number of aldermen to one-half of
11    the total authorized by Section 3.1-20-10, with one  alderman
12    representing  each ward, shall be certified by the city clerk
13    to the proper election  authorities,  who  shall  submit  the
14    proposition  at  an  election  in accordance with the general
15    election law, if a petition requesting that action is  signed
16    by  electors  of  the city numbering not less than 10% of the
17    total vote cast at the last election for mayor  of  the  city
18    and the petition is filed with the city clerk.
19        The  proposition  shall be substantially in the following
20    form:
21             Shall (name of city) restrict the number of aldermen
22        to (state number) (one-half of the  total  authorized  by

 1        Section  3.1-20-10  of the Illinois Municipal Code), with
 2        one alderman representing each ward?
 3        If a majority of those voting on the proposition vote  in
 4    favor of it, all existing aldermanic terms shall expire as of
 5    the  date  of  the next regular aldermanic election, at which
 6    time a full complement of aldermen shall be elected  for  the
 7    full term.
 8        (b)  In  a  city  of  less  than  100,000  inhabitants, a
 9    proposition  to  restrict  the  number  of  aldermen  to  one
10    alderman per ward, with one alderman representing each  ward,
11    plus  an  additional  number  of  aldermen  not to exceed the
12    number of wards in the city to be elected at large, shall  be
13    certified   by   the   city  clerk  to  the  proper  election
14    authorities, who shall submit the proposition at an  election
15    in  accordance  with  the general election law, if a petition
16    requesting that action is signed  by  electors  of  the  city
17    numbering  not  less  than  10% of the total vote cast at the
18    last election for mayor of the city and the petition is filed
19    with the city clerk.
20        The proposition shall be substantially in  the  following
21    form:
22             Shall (name of city) restrict the number of aldermen
23        to  (number),  with  one alderman representing each ward,
24        plus an additional (number)  alderman  (aldermen)  to  be
25        elected at large?
26        If  a majority of those voting on the proposition vote in
27    favor of it, all existing aldermanic terms shall expire as of
28    the date of the next regular aldermanic  election,  at  which
29    time  a  full complement of aldermen shall be elected for the
30    full term.
31        (c)  In a city of less than 100,000 inhabitants  where  a
32    proposition  under subsection (a) or (b) has been successful,
33    a  proposition  to  reinstate  the  number  of  aldermen   in
34    accordance  with  Section 3.1-20-10 shall be certified by the

 1    city clerk to the  proper  election  authorities,  who  shall
 2    submit  the proposition at an election in accordance with the
 3    general election law, if a petition  requesting  that  action
 4    has  been  signed  by electors of the city numbering not less
 5    than 10% of the total vote cast  at  the  last  election  for
 6    mayor  of  the  city and the petition has been filed with the
 7    city clerk.
 8        The election authority must  submit  the  proposition  in
 9    substantially the following form:
10             Shall   (name  of  city)  reinstate  the  number  of
11        aldermen  to  (number  of  aldermen  allowed  by  Section
12        3.1-20-10)?
13    The election authority must record  the  votes  as  "Yes"  or
14    "No".
15        If  a  majority of the electors voting on the proposition
16    vote in the affirmative, then,  if  the  restriction  in  the
17    number  of aldermen has taken effect, all existing aldermanic
18    terms shall expire  as  of  the  date  of  the  next  regular
19    aldermanic  election,  at  which  time  a  full complement of
20    aldermen shall be elected for the full  term  and  thereafter
21    terms   shall   be  determined  in  accordance  with  Section
22    3.1-20-35.
