 1        AN ACT in relation to public employee compensation.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Local Government Officer Compensation Act
 5    is amended by changing Section 2 as follows:

 6        (50 ILCS 145/2)
 7        Sec. 2.  Time of fixing compensation.
 8        (a)  Except   as   provided   in   subsection   (b),  and
 9    notwithstanding  any  other  law   to   the   contrary,   the
10    compensation  of  elected  officers  of  school districts and
11    units of local government, including home rule  units,  which
12    compensation  is  to be fixed by that school district or unit
13    of local government, shall be fixed at least 180 days  before
14    the beginning of the terms of the officers whose compensation
15    is to be fixed.
16        (b)  County  boards shall comply with the requirements of
17    this amendatory Act of the 92nd General Assembly by the dates
18    specified in those requirements.  In the case of any conflict
19    between the requirements  of  this  amendatory  Act  and  the
20    provisions   of   subsection   (a)   of   this  Section,  the
21    requirements of this amendatory Act control.

23        Section 10.  The Counties Code  is  amended  by  changing
24    Sections 3-6037 and 4-6003 as follows:

25        (55 ILCS 5/3-6037) (from Ch. 34, par. 3-6037)
26        Sec. 3-6037.  Salary of Supervisor of Safety.  The county
27    board  may,  but  need not, allow the Supervisor of Safety an
28    annual salary.  Beginning December 1,  2002,  if  the  county
29    board  allows the Supervisor of Safety an annual salary, that

 1    annual salary shall not  be  less  than  not  to  exceed  the
 2    following:
 3        In  counties  of  less than 20,000 population, the sum of
 4    $1,500;
 5        In counties of  20,000  or  more  and  less  than  30,000
 6    population, the sum of $2,000;
 7        In  counties  of  30,000  or  more  and  less than 50,000
 8    population, the sum of $2,500;
 9        In counties of  50,000  or  more  and  less  than  75,000
10    population, the sum of $3,000;
11        In  counties  of  75,000  or  more  and less than 100,000
12    population, the sum of $3,500;
13        In counties of 100,000 or  more  and  less  than  500,000
14    population, the sum of $4,000;
15        In  counties  of  500,000  or more population, the sum of
16    $4,500.
17        The word "population" when used  in  this  section  shall
18    mean  the  population  as  determined  by  the last preceding
19    Federal Census.
20        These salaries shall be without regard  to  and  separate
21    from  the  salaries that may be fixed by the county board for
22    the Sheriff, and shall be payable out of the County Treasury.

25        Sec.  4-6003.  Compensation  of  sheriffs   for   certain
26    expenses in counties of less than 2,000,000.
27        (a)  The  County  Board,  in  all  counties  of less than
28    2,000,000  inhabitants,  shall  fix   the   compensation   of
29    sheriffs,  with  the  amount  of  their necessary clerk hire,
30    stationery, fuel and other expenses.  The county shall supply
31    the sheriff with all necessary uniforms, guns and ammunition.
32    The  compensation  of  each  such  officer  shall  be   fixed
33    separately  from  his  necessary clerk hire, stationery, fuel

 1    and other expenses.  Beginning immediately, no county with  a
 2    population   under   2,000,000   may   reduce   the  rate  of
 3    compensation of its sheriff below the  rate  of  compensation
 4    that it was actually paying to its sheriff on January 1, 2002
 5    or  the  effective  date  of  this amendatory Act of the 92nd
 6    General Assembly, whichever is greater.
 7        (b)  In addition to the requirement  of  subsection  (a),
 8    the rate of compensation payable to the sheriff by the county
 9    shall  not  be  less  than  the  following, as adjusted under
10    subsection (c) and such compensation shall  be  fixed  within
11    the following limits:
12        To  each  such  sheriff  in counties containing less than
13    10,000 inhabitants, not less than $27,000 per annum.
14        To each such sheriff in  counties  containing  10,000  or
15    more  inhabitants  but less than 20,000 inhabitants, not less
16    than $31,000 per annum.
17        To each such sheriff in  counties  containing  20,000  or
18    more  inhabitants  but less than 30,000 inhabitants, not less
19    than $34,000 per annum.
20        To each such sheriff in  counties  containing  30,000  or
21    more  inhabitants  but less than 60,000 inhabitants, not less
22    than $37,000 per annum.
23        To each such sheriff in  counties  containing  60,000  or
24    more  inhabitants but less than 100,000 inhabitants, not less
25    than $40,000 per annum.
26        To each such sheriff in counties  containing  100,000  or
27    more  inhabitants  but  less  than 2,000,000 inhabitants, not
28    less than $43,000 per annum.
29        The population of each county for the purpose  of  fixing
30    compensation as herein provided, shall be based upon the last
31    federal  census  immediately  previous to the election of the
32    sheriff in question in such county.
33        (c)  The minimum rate of annual compensation for sheriffs
34    provided under subsection (b) shall be increased on  December

 1    1,  2003,  and  on  each December 1 thereafter, by the annual
 2    cost of living adjustment specified in this subsection.
 3        The  annual  cost  of  living  adjustment  shall   be   a
 4    percentage  increase  in  the  minimum  salary  equal  to the
 5    percentage increase, if any, in  the  cost  of  living  index
 6    known  as  the "Employment Cost Index, Wages and Salaries, by
 7    Occupation and Industry Group:  State  and  Local  Government
 8    Workers:   Public Administration", as published by the United
 9    States Department of Labor, Bureau of Labor  Statistics,  for
10    the  12  months  ending  with the month of June preceding the
11    December in which the adjustment  is  to  take  effect.   The
12    annual  cost  of living adjustment shall take effect December
13    1, except that the actual salary paid to any  person  holding
14    the   office  of  sheriff  on  the  effective  date  of  this
15    amendatory Act of the 92nd General Assembly shall not include
16    the annual cost of living adjustment until the expiration  of
17    that term.
18        (b)  Those  sheriffs  beginning  a  term of office before
19    December 1, 1990 shall be compensated at the  rate  of  their
20    base salary.  "Base salary" is the compensation paid for each
21    of those offices, respectively, before July 1, 1989.
22        (c)  Those  sheriffs  beginning  a  term  of office on or
23    after December 1, 1990 shall be compensated as follows:
24             (1)  Beginning December 1, 1990, base salary plus at
25        least 3% of base salary.
26             (2)  Beginning December 1, 1991, base salary plus at
27        least 6% of base salary.
28             (3)  Beginning December 1, 1992, base salary plus at
29        least 9% of base salary.
30             (4)  Beginning December 1, 1993, base salary plus at
31        least 12% of base salary.
32        (d)  In  addition  to  the   salary   provided   for   in
33    subsections  (a),  (b),  and (c), beginning December 1, 1998,
34    each sheriff for their additional  duties  imposed  by  other

 1    statutes  or  laws shall receive an annual stipend to be paid
 2    by the State in the amount of $6,500.
 3        (e)  No county board may reduce or otherwise  impair  the
 4    compensation  payable  from  county funds to a sheriff if the
 5    reduction  or  impairment  is  the  result  of  the   sheriff
 6    receiving an award or stipend payable from State funds.

 8        Section  90.  The State Mandates Act is amended by adding
 9    Section 8.26 as follows:

10        (30 ILCS 805/8.26 new)
11        Sec. 8.26. Exempt mandate.   Notwithstanding  Sections  6
12    and  8 of this Act, no reimbursement by the State is required
13    for  the  implementation  of  any  mandate  created  by  this
14    amendatory Act of the 92nd General Assembly.

15        Section 99. Effective date.  This Act takes  effect  upon
16    becoming law.
