MORROW. 510 ILCS 5/16.5 new Amends the Animal Control Act. Provides that a person commits a Class 4 felony if that person negligently, recklessly, knowingly, or intentionally allows a dog or other animal to cross the property line of the premises where the dog or other animal is being kept, if that dog or other animal, unprovoked, causes great bodily harm, disfigurement, disability, or death to another person, and if that other person was in a place where he or she may lawfully be. It is a rebuttable presumption that the dog or other animal was unprovoked. JUDICIAL NOTE (Administrative Office of Illinois Courts) There may be an increase in judicial workloads due to HB 3984; however, the bill would not increase the number of judges needed in the State. FISCAL NOTE (Department of Corrections) The impact on the Department is expect to be minimal. Each person sentenced to prison for a Class 4 felony would serve an average of six months at a cost of $10,319 and would require the construction of one additional prison bed at the cost of $50,510.
